NoneThe UK’s Competition and Markets Authority (CMA) has “provisionally concluded” that Apple’s restrictive mobile browser policies limit innovation. After an independent inquiry group shared its findings on browser competition on iOS and Android, the governing body’s board plans to conduct an in-depth assessment of how Apple and Google constrict third-party browsers on their platforms. However, Apple — with its more closed ecosystem — appears to have borne the brunt of the CMA’s concern. The CMA’s investigation is based on the premise that Apple and Google have an effective duopoly on mobile platforms, allowing them to set the rules of how mobile browsers work. The board says third-party browser developers have complained that they’re constricted by rules like Apple’s requirement to use the company’s WebKit browser engine. ADVERTISEMENT Advertisement “The group has provisionally found that Apple’s rules restrict other competitors from being able to deliver new, innovative features that could benefit consumers,” the CMA wrote. “Other browser providers have highlighted concerns that they have been unable to offer a full range of browser features, such as faster webpage loading on iPhone.” The Digital Markets, Competition and Consumers Act (DMCC), which passed earlier this year , will give the UK body extra ammunition to carry out its next steps. The UK’s equivalent of the EU’s Digital Markets Act (DMA) can designate big tech companies as having “Strategic Market Status” with “substantial and entrenched market power” and “a position of strategic significance.” Much like the EU’s version, the law gives the UK some teeth to negotiate and force concessions from Big Tech behemoths that, at least in the US, often seem untouchable: The DMCC will empower the UK board to fine infringing companies up to 10 percent of their global revenue. The CMA’s summary of Apple’s hearing reveals the iPhone maker argued that it restricts browser engines to “ensure users get the best security, privacy, and performance on iOS devices” — a familiar argument to those who’ve followed Apple’s previous competition trials. Apple claimed healthy competition exists, due to the presence of third-party browsers with features like ad-blocking, VPNs and AI. The company also said it routinely considers developer feedback and hadn’t heard any fuss over its current browser rules. ADVERTISEMENT Advertisement Contradicting that, the CMA said other browser providers have highlighted features they can’t implement on iOS, like faster webpage loading. “Many smaller UK app developers also told us that they would like to use progressive web apps — an alternative way for businesses to provide apps to mobile users without downloading apps through an app store — but this technology is not able to fully take off on iOS devices,” the board wrote. The CMA also said that how browser choices are presented to users lets Apple and Google “manipulate these choices to make their own browsers the clearest or easiest option.” In addition, it pointed out a revenue-sharing agreement between the two companies that “significantly reduces their financial incentives to compete in mobile browsers on iOS.” The board’s next step is a period of open comments on its findings, which will end on December 13. After its investigation, the CMA expects to make its final ruling in March 2025.

The courtroom erupted in applause as the panelists acquitted Penny of criminally negligent homicide — which could have put him behind bars for up to four years — in Neely’s chokehold death aboard a crowded uptown F train in May 2023. “We the jury have come to a unanimous decision on count two,” the foreperson on the jury told the courtroom. Penny immediately broke out a huge smile and turned to hug defense attorney Thomas Kenniff — even as Neely’s father, Andre Zachary, was escorted from the courtroom. “Racist f****** country,” one Black Lives Matter supporter yelled as she left the room. Another Neely supporter, turning to Penney, screamed, “It’s a small world, buddy,” before leaving the room. Manslaughter, the top charge against Penny, was tossed on Friday after jurors twice said they couldn’t reach a unanimous verdict. Jurors sided with Penny’s defense attorneys, who had argued that the Marine veteran was justified in rushing to protect his fellow subway straphangers when he subdued the erratic homeless man. The lawyers had also questioned whether there was sufficient evidence that the chokehold caused Neely’s death. “Who do you want on the next train ride with you?” one of his lawyers, Steven Raiser, in his closing statement in Manhattan Supreme Court. The verdict drew an immediate reaction from across the nation. “Daniel Penny’s actions were heroic & protected the lives of people on that train,” House Speaker Mike Johnson wrote on X. “We used to celebrate bravery like this in America, but the Left continues their crusade to protect criminals and prosecute heroes,” Johnson said. “Good to see this charge dismissed.” In the Big Apple, city Councilman Joe Borelli (R-Staten Island) said the jury’s decision “underscores nothing other than the perverse sense of justice held by [Manhattan DA] Alvin Bragg. “Every New Yorker is fearful on the subway and had no problem understanding the context of Daniel Penny’s actions,” he said. “The district attorney should resign in shame.” The acquittal comes after jurors heard from more than 40 witnesses, including passengers who described Neely’s terrifying outburst on the train before Penny approached him from behind and took him down at the Broadway-Lafayette station. One straphanger testified she was “scared s–tless” hearing Neely ranting about being “willing to die and go to jail.” She later thanked Penny for stepping in to restrain Neely, who also raged that “someone is going to die today.” Another woman on the train told jurors that she feared for her life after hearing Neely’s “satanic” rant. And a mother who was taking her 5-year-old son to a doctor’s appointment testified that she was so scared of a “belligerent and unhinged” Neely that she barricaded her son behind his stroller. No witness testified that Neely put his hands on anyone, or lunged at a specific person, before Penny put him in the chokehold. Evidence during the month-long trial also revealed that Neely was not carrying a weapon at the time — with cops finding only a muffin in his pocket. The polarizing case kicked off fierce conversation about a mentally ill man who was failed by the city’s broken system — a sentiment even Mayor Eric Adams expressed, saying Penny did “what we should have done as a city” by protecting others that day. Prosecutors argued that Penny went “too far” — and that his actions turned criminal when he kept Neely in the hold after nearly all of the frightened passengers had fled the train. “What’s so tragic about this case is that even though the defendant started out trying to do the right thing, as the chokehold progressed, the defendant knew that Jordan Neely was in great distress and dying, and he needlessly continued,” prosecutor Dafna Yoran said in her closing statement. Jurors watched frame-by-frame footage from a bystander’s six-minute video of Penny holding Neely — including for 51 seconds after Neely’s body appears to go limp. Penny kept holding Neely despite witnesses pleading with him to “let him go!,” the video shows. Dr. Cynthia Harris, who ruled that Neely’s death was a homicide caused by Penny’s chokehold, pointed out for jurors the exact moment when Neely passed out on the subway car’s floor — with Penny still wrapping his arm around Neely’s neck. The city medical examiner, who made her ruling before Neely’s toxicology report came back, testified that she was so confident after watching video of the encounter that she’d stand by her decision even if it later turned out that Neely had enough drugs in his body “to put down an elephant.” Jurors asked for a readback of that specific portion of Harris’ testimony during deliberations. Trial evidence revealed that Neely had the synthetic marijuana drug K2 in his system at the time of the confrontation. Jurors also heard that he was diagnosed with schizophrenia, telling doctors in 2021 that he’d heard the “devil’s voice.” Penny’s mother, sister, friends and fellow Marines took the stand to vouch for his character. The defense’s medical expert, forensic pathologist Dr. Satish Chundru, claimed that Neely died not from Penny’s chokehold, but by “the combined effects of sickle cell crisis, the schizophrenia, the struggle and restraint, and the synthetic marijuana.” Penny declined to take the stand. But jurors heard him tell arriving cops on the train platform, “I just put him out,” before making a choking gesture with his arms. Hours later, at Chinatown’s 5th Precinct, a relaxed Penny insisted during an interrogation that he was merely trying to “de-escalate the situation” and that he didn’t mean to hurt Neely. “I’m not trying to kill the guy,” the Marine veteran told two detectives, as prosecutors watched him through a one-sided mirror. “I’m just trying to keep him from hurting anybody else.” In an apparent reference to the mentally ill Neely, Penny added during his questioning that “all these people are pushing people in front of the train and stuff.” Neely’s death, and Penny’s arrest 11 days later, sparked a national political firestorm about whether Penny’s actions were justified. The episode also sparked outrage about how Neely fell through the cracks of the city’s mental health system, failing to get the treatment he needed despite the NYPD treating him as an “emotionally disturbed person” in more than two dozen prior encounters with him. “This case is about a broken system, a broken system that does not help our mentally ill or our unhoused,” Penny’s attorney Raiser said at the end of his closing statement. “In fact, it is that broken system that led us, that is interwoven into the very fabric of this case.” In a statement, the city council’s progressive caucus denounced the verdict, saying it “highlights the deep-seated [ck] societal discomfort with unhoused individuals. “Jordan Neely was failed by the city’s social service system for years,” the statement said. “He was failed by our city when Daniel Penny put him in a chokehold on the subway. U.S. District Judge Lewis J. Liman responded by saying he’s not going to let the former New York City mayor and onetime presidential candidate blurt things out anymore in court unless he’s a sworn witness. The interruption to an otherwise routine pretrial hearing in Manhattan came as the judge questioned Giuliani's lawyer about why Giuliani has not yet provided the title to a car he has relinquished in his effort to satisfy a $148 million defamation judgment won by two former Georgia election workers. “Your client was the U.S. attorney for this district,” the judge said, referring to Giuliani's years in the 1980s as the head of the federal prosecutor's office in the Southern District of New York, as he suggested it was hard to believe that Giuliani was incapable of getting a duplicate title to the car. Giuliani learned forward and began speaking into a microphone, telling the judge he had applied for a duplicate copy of the car's title but that it had not yet arrived. “The implication I’ve been not diligent about it is totally incorrect,” Giuliani said in a scolding tone. “The implication you make is against me and every implication against me is wrong.” Giuliani went on: "I’m not impoverished. Everything I have is tied up. I don’t have a car. I don’t have a credit card. I don’t have cash. I can’t get to bank accounts that truly would be mine because they have put ... stop orders on, for example, my Social Security account, which they have no right to do.” Liman responded by warning defense lawyers that the next time Giuliani interrupts a hearing, “he's not going to be permitted to speak and the court will take action.” The judge said Giuliani could either choose to represent himself or let lawyers do so, but “you can't have hybrid representation.” If Giuliani wants to speak in court again, he can be put on the witness stand and be sworn as a witness, Liman added. Cammarata asked Liman to delay the trial, which will be heard without a jury, for a month because of Giuliani's “involvement" in inauguration planning for President-elect Donald Trump. “My client regularly consults and deals directly with President-elect Trump on issues that are taking place as the incoming administration is afoot as well as (the) inauguration," Cammarata said. If fulfilling your lengthy list feels overwhelming, learning what brain science and evolutionary psychology say about shopping and gift-giving might help you understand exactly why you're stressed – and even point you toward a healthier, happier holiday season. Our reactions are encoded into our nervous system, said Dr. Beth Frates, a part-time associate professor in the department of physical medicine and rehabilitation at Harvard Medical School in Boston. "By understanding these brain responses, people can develop strategies to manage stress better, such as setting realistic expectations, focusing on mindfulness and simplifying holiday preparations," said Frates, who also is the immediate past president of the American College of Lifestyle Medicine. The idea of exchanging gifts at this time of year can be traced back to pagan solstice celebrations. But the drive to share with another is as old as humanity itself, said Dr. Diego Guevara Beltran, a postdoctoral fellow in psychology at the University of Arizona in Tucson who studies cooperation and generosity. The science of generosity is more about survival than stocking stuffers, Guevara Beltran said. Sharing food gave early humans an evolutionary advantage. "Generosity is just one of the ways by which we can accumulate resources, be it wealth itself or friendships or work partners or more attractive, more intelligent mates," he said. Sharing with other people, Guevara Beltran said, is "a signal that communicates how much you value them, their welfare, your relationship with them." Research has shown that helping people makes us feel good. Part of that, he said, is because when someone is part of a community, they feel protected. One way this manifests is through the act of giving gifts. But to derive happiness from gift-giving, the giver needs to feel both that it was not an obligation and that it was effective, according to the 2019 World Happiness Report . That means it could be stressful to be in a culture where gift-giving feels mandatory, or if we can't see that a gift helped someone, Guevara Beltran speculated. It also might be stressful if gift-giving becomes a competition to show that you care about somebody more than the others around them. Our brains on shopping Stressful shopping can cause several physiological responses to kick in, Frates said. First is the "fight or flight" reaction that comes with stress. The release of chemicals that increase our heart rate, raise our blood pressure and intensify our breathing evolved to give us bursts of energy to escape danger. Frates said that while holiday stressors are not life-threatening, they can still trigger the stress response. The pressure to stay within budget could create a sense of scarcity, she said. "This taps into an evolutionary response, where the fear of losing resources like money can feel urgent and distressing." The holiday season also involves a lot of choices. "The brain has limited capacity for decision-making, and making multiple decisions can lead to decision fatigue," Frates said. "This fatigue reduces the ability to self-regulate and cope, which can lead to heightened stress responses when confronted with even minor setbacks, like a long line or out-of-stock item." The stress of needing to complete tasks within a limited time can intensify the fight-or-flight response, she said, as the brain interprets the ticking clock as a sense of urgency or threat. Meanwhile, Frates said, holiday shopping can also trigger brain chemicals that affect our feelings. "Dopamine, a neurotransmitter associated with pleasure and reward, is released when we anticipate something exciting or enjoyable, like finding a great gift or finding a good deal," she said. "This anticipation can feel rewarding even before any actual purchase is made." For some people, this dopamine boost can make shopping a relaxing experience. "It provides a temporary distraction from other stressors and allows them to focus on something positive, creating a 'holiday high,'" Frates said. For some people, that can be problematic. "When shopping becomes a way to chase that next dopamine hit, it can lead to excessive spending or impulsive purchases," she said. "This can become a trap, particularly during the holidays, when deals, sales and gift-giving pressures are everywhere." Understanding how all these processes work can help people recognize why they feel the way they do and adopt strategies to cope, Frates said. Here are some of her suggestions. 1. Start with self-care before shopping Prioritizing self-care means people can be their best selves and make good decisions, Frates said. So, "eat food that is delicious and nutritious. Get seven to nine hours of sleep. Make sure to enjoy physical activity. Take walks when you can and invite friends along. Practice stress reduction like meditation or yoga to help you calm your body and mind." Before going shopping, try taking deep breaths using stress-relieving techniques such as 4-7-8 breathing (inhale through your nose for four counts, hold for seven counts, and exhale through your mouth for eight) or box breathing (inhale through the nose for four counts, hold your breath for four, exhale for four, then hold for four). 2. Be strategic Don't shop when you're hungry, tired, lonely or stressed, Frates said. And don't start shopping 15 minutes before a store closes or a website's online deals end, she said. That's setting yourself up for triggering the fight-or-flight response. 3. Be mindful Before making a purchase, take a moment to consider whether it's truly needed or whether it's an impulsive choice. To avoid overindulging, set a specific budget or limit yourself to a couple of hours or specific shopping days. "This keeps dopamine-driven spending in check while still allowing for the enjoyable aspects of holiday shopping," Frates said. Look for post-shopping activities that provide rewards without the financial cost. That can satisfy your brain's desire for more dopamine in a healthier way. "Plan enjoyable, stress-relieving activities after shopping, like going for a walk, spending time with friends or indulging in a hobby," she said. 4. Bring a friend Not only does this support healthy social connections, Frates said, but if things start feeling stressful, "you have a buddy, and you have a support system right there for you." 5. Rethink the focus of the season "With gift-giving, we need to change mindsets in order to be able to manage the stress," Frates said. The holidays could be used to emphasize social connections, she said. "Thinking about the connection with the person and making gift-giving more about deepening the connection than anything else, I think, will really help to reduce the stress around the process," she said. So instead of scouring shops and websites for the "perfect" gift, think about making a meaningful and personal one, she suggested. It could be a poem, a painting, a song or a framed photograph that captured a special time. 6. Lessons for children It's easy to get caught up in the hunt for a hard-to-get item, Frates said. The index has now declined in five out of the last six trading sessions. On the other hand, S&P 500 and Nasdaq retreated from their respective record high levels, declining 0.6% each. Nvidia shares fell over 3% after China opened a probe over suspicions that the chipmaker and currently the most valuable company in the world, broke anti-monopoly laws around a deal it made in 2020. Meantime, Chinese stocks that are listed in the US staged a sharp rally as top leaders in Beijing used their most direct language yet on providing monetary easing and boosting domestic consumption. The Nasdaq Golden Dragon China Index, which tracks the biggest Chinese stocks in the US, climbed nearly 10%, its strongest intraday gain since late September. Large-cap technology stocks including Alibaba Group Holding Ltd. and PDD Holdings Inc. rose more than 7% each in New York trading. Shares of Western companies with high revenue exposure in China also rallied. In the US, consumer names Estée Lauder Cos. and Amer Sports Inc. traded higher. In Europe, miners such as Rio Tinto Plc and luxury brands like LVMH led stock gains in the region’s equity benchmark. The new findings can help develop diagnostic tools for the deadly infection, declared a global health emergency twice by the World Health Organization (WHO) in the last three years. The 2024 global outbreak saw the disease spread to about 15 countries in Africa, and three out of Africa. The outbreak has raised serious concern about its unanticipated spread across the globe, as the modes of transmission and symptoms are not well understood. A comprehensive understanding of virology, alongside the rapid development of effective diagnostic and therapeutic strategies, is of paramount importance. “MPV is a double-stranded DNA (dsDNA) virus. The detection of the extracellular viral protein gene through polymerase chain reaction (PCR) is a widely established technique for identifying MPV in clinical specimens,” said the researchers. Currently, the disease is detected via PCR, relying on the amplification of double-stranded DNA (dsDNA), which also employs fluorescent probes for quantifying amplification. The team identified and characterised highly conserved GQ — a four-stranded unusual and characteristic DNA structure within the MPV genome. They specifically detected a specific GQ sequence using a tailored fluorescent small-molecule probe, enabling precise detection of MPV. “These GQ sequences are stable under physiological conditions, highly conserved, and are not present in other pox viruses, other pathogens, and the human genome. These characteristics make the GQ sequences valuable targets for the development of diagnostic tools and therapeutic intervention,” explained the team. Their fluorogenic molecular probe (BBJL) delivered “more than 250-fold enhancement in fluorescence output upon binding with MPV GQs (MP2). The ability of BBJL to selectively detect this highly conserved sequence in the MPV genome sets a precedent for the development of detection techniques targeting noncanonical nucleic acids”. Additional mapping of the MPV genome is being performed to identify potential GQ targets for future therapeutics. Consequently, this study augments the development of potential detection platforms based on GQ, and the GQs identified can be further investigated for their anti-viral properties. Such molecular probes with superior conformation or sequence-specific recognition of nucleic acids could alleviate the challenge in existing amplification-based techniques, in discriminating false-positive results arising from non-specific amplification. The identification and characterisation of new GQ sequences in the MPV could help the broader scientific community seeking to understand the virology of MPV or develop diagnostic and therapeutic interventions, said researchers.

Started by Fraser Young, the petition states that there are no services for Vernon residents to use BC Transit to get to Kelowna's downtown area before 8:30 a.m. Young's request is that Bus 97 which traditionally starts at 6 a.m. at UBC Okanagan in Kelowna's north end connect with Route 90 allowing for Vernon residents to catch a bus to Kelowna or West Kelowna starting at 5 a.m. "We believe that everyone should have equal access to public transportation, and no one should be left stranded due to systemic shortfalls," the petition reads.
