The counties won their initial lawsuit — and were awarded $650 million in damages by a federal judge in 2022 — but the pharmacies had disputed the court's reading of the Ohio Product Liability Act, which they said protected them from such sanctions. TikTok's future in the U.S. appeared uncertain on Friday after a federal appeals court to a law that requires the social media platform to cut ties with its China-based parent company or be banned by mid-January. A panel of three judges on The U.S. Court of Appeals for the District of Columbia Circuit ruled unanimously that the law withstood constitutional scrutiny, rebuffing arguments from the two companies that the statute violated their rights and the rights of TikTok users in the U.S. The government has said it wants ByteDance to divest its stakes in TikTok. But if it doesn't and the platform goes away, it would have a seismic impact on the lives of content creators who rely on the platform for income as well as users who use it for entertainment and connection. Here are some details on the ruling and what could happen next: In their lawsuit, TikTok and ByteDance, which is also a plaintiff in the case, had challenged the law on various fronts, arguing in part that the statute ran afoul of the First Amendment and was an unconstitutional bill of attainder that unfairly targeted the two companies. But the court sided with attorneys for the Justice Department who said that the government was attempting to address national security concerns and the way in which it chose to do so did not violate the constitution. The Justice Department has argued in court that TikTok poses a national security risk due to its connections to China. Officials say that Chinese authorities can compel ByteDance to hand over information on TikTok's U.S. patrons or use the platform to spread, or suppress, information. However, the U.S. hasn't publicly provided examples of that happening. The appeals court ruling, written by Judge Douglas Ginsburg, said the law was “carefully crafted to deal only with control by a foreign adversary." The judges also rejected the claim that the statute was an unlawful bill of attainder or a taking of property in violation of the Fifth Amendment. Furthermore, Ginsburg wrote the law did not violate the First Amendment because the government is not looking to “suppress content or require a certain mix of content” on TikTok. TikTok and ByteDance are expected to appeal the case to the Supreme Court, but it's unclear whether the court will take up the case. TikTok indicated in a statement on Friday the two companies are preparing to take their case to high court, saying the Supreme Court has “an established historical record of protecting Americans’ right to free speech." "We expect they will do just that on this important constitutional issue,” a company spokesperson said. Alan Morrison, a professor at The George Washington University Law School, said he expects the Supreme Court to take up the case because of the novelty of the issues raised in the lawsuit. If that happens, attorneys for the two companies still have to convince the court to grant them an emergency stay that will prevent the government from enforcing the Jan. 19 divestiture deadline stipulated in the law, Morrison said. Such a move could drag out the process until the Justices make a ruling. Tiffany Cianci, a TikTok content creator who has supported the platform, said she was not shocked about the outcome of the court's ruling on Friday because lower courts typically defer to the executive branch on these types of cases. She believes the company will have a stronger case at the Supreme Court. “I believe that the next stages are more likely to produce a victory for TikTokers and for TikTok as a whole,” Cianci said. Another wild card is President-elect Donald Trump, who tried to ban TikTok during his first term but said during the recent presidential campaign that he is now . The Trump transition team has not offered details on how Trump plans to carry out his pledge to “save TikTok." But spokeswoman Karoline Leavitt said in a statement last month that he plans to “deliver” on his campaign promises. After Trump takes office on Jan. 20th, it would fall on his Justice Department to enforce the law and punish any potential violators. Penalties would apply to any app stores that would violate a prohibition on TikTok and to internet hosting services which would be barred from supporting it. Some have speculated that Trump could ask his Justice Department to abstain from enforcing the law. But tech companies like Apple and Google, which offer TikTok's app on their app stores, would then have to trust that the administration would not come after them for any violations. Craig Singleton, senior director of the China program at the Foundation for Defense of Democracies, said enforcement discretion — or executive orders — can not override existing law, leaving Trump with “limited room for unilateral action." There are other things Trump could potentially do. It's possible he could invoke provisions of the law that allow the president to determine whether a sale or a similar transaction frees TikTok from “foreign adversary” control. Another option is to urge Congress to repeal the law. But that too would require support from congressional Republicans who have overwhelmingly of getting TikTok out of the hands of a Chinese company. In a statement issued Friday, Republican Rep. John Moolenaar of Michigan, chairman of the House Select Committee on China, said he was “optimistic that President Trump will facilitate an American takeover of TikTok” and allow its continued use in the United States. ByteDance . And even if it wanted to, a sale of the proprietary algorithm that powers TikTok is likely to get blocked under Chinese export controls that the country issued in 2020. That means if TikTok is sold without the algorithm, its likely that the buyer would only purchase a shell of the platform that doesn't contain the technology that made the app a cultural powerhouse. Still, some investors, including and billionaire Frank McCourt, have expressed interest in buying it. This week, a spokesperson for McCourt’s Project Liberty initiative, which aims to protect online privacy, said participants in their bid have made informal commitments of more than $20 billion in capital. The Biden administration has pledged to make a new push for a Gaza ceasefire now that there’s a truce in Lebanon between Israel and the militant group Hezbollah, ending more than a year of cross-border fighting. Meanwhile, President-elect Donald Trump demanded this week the release of hostages held by Hamas before he is sworn into office in January. Wednesday’s strike in Muwasi — a desolate area with few public services that holds hundreds of thousands of displaced people — wounded at least 28 people, according to Atif al-Hout, the director of Nasser Hospital in the southern city of Khan Younis. An Associated Press journalist at the hospital counted at least 15 bodies, but said reaching a precise number was difficult because many of the dead were dismembered, some without heads or badly burned. In the morgue, an infant’s blackened hand and face peeked out from beneath a heavy blanket used to transport bodies to the hospital. “It was like doomsday,” said a wounded woman, Iman Jumaa, who held back tears as she described how the strike killed her father, her brothers and her brothers’ children. Videos and photos of the strike shared widely on social media showed flames and a column of black smoke rising into the night sky, as well as twisted metal tent frames and shredded fabric. Palestinian men searched through the still-burning wreckage, shouting, “Over here guys!” Further away, civilians stood at a distance, observing the destruction. The military said the strikes had set off secondary blasts, indicating explosives present in the area had detonated. It was not possible to independently confirm the Israeli claims, and the strikes could also have ignited fuel, cooking gas canisters or other materials in the camp. Shortly after the strike, Al-Awda Hospital said two people had been killed and 38 wounded in an attack on a residential block in the Nuseirat refugee camp. The military had no immediate comment on the strike, but said earlier strikes in central Gaza had hit “terrorist targets.” Israel says it tries to avoid harming civilians and blames Hamas for their deaths, saying the militants often operate in residential areas and are known to position tunnels, rocket launchers and other infrastructure near homes, schools and mosques. The 57-year-old said her family has been eating grass, leaves, and animal feed for two months due to the lack of food aid in the north. The amount of aid entering Gaza plunged in October, and hunger is widespread across the territory, even in central Gaza where aid groups have more access. Humanitarian organizations say Israeli restrictions, ongoing fighting and the breakdown of law and order make it difficult to deliver assistance. Israel has said it is working to increase the flow of aid. Israel’s offensive has killed over 44,500 Palestinians in Gaza, mostly women and children, according to the Gaza Health Ministry, which does not say how many were combatants. The Israeli military says it has killed over 17,000 militants, without providing evidence. The Oct. 7, 2023 Hamas-led attack on southern Israel killed some 1,200 people, mostly civilians, and around 250 people were abducted. Some 100 hostages are still inside Gaza, at least a third of whom are believed to be dead. On Wednesday, Israel said its forces recovered the body of a hostage who was captured alive during the Oct. 7 attack. Israel believes Itay Svirsky was killed by his captors. The families of hostages held in Gaza have grown increasingly concerned that their loved ones are at risk so long as the war continues. (AP) — Two New Hampshire fathers who were barred from school district events for wearing pink wristbands marked “XX” to represent female chromosomes insisted at a federal court hearing Thursday that they didn't set out to harass or otherwise target a transgender soccer player at the game they attended. But a judge hearing the case suggested the message the parents sent may matter more than their intentions. Kyle Fellers and Anthony Foote sued the Bow school district after being banned from school grounds for wearing the wristbands at their daughters' soccer game in September. The no-trespass orders have since expired, but a judge is deciding whether the plaintiffs should be allowed to wear the wristbands and carry signs at upcoming school events, including basketball games, swim meets and a music concert, while the case proceeds. Testifying at Thursday's hearing, both men said that they did not view the wristbands as a protest against Parker Tirrell, a transgender girl on the opposing team, but rather as a show of support for their daughters and their teammates. U.S. District Court Judge Steven McAuliffe questioned whether there is a meaningful distinction and whether their intentions matter. “Sometimes the message you think you’re sending might not be the message that is being sent,” he said. McAuliffe asked Foote whether it occurred to him that a transgender person might interpret the pink XX wristbands as an attempt to invalidate their existence. “If he’s a trans female, pink might be a color he likes,” Foote said. McAuliffe also noted that while both plaintiffs said they had no problem with transgender people outside the issue of sports, they repeatedly referred to the athlete in question as a boy. “You seem to go out of your way to suggest there’s no such thing as a trans girl,” McAuliffe said. Foote disagreed, saying it was “like learning a new language” to refer to transgender people. In a separate courtroom earlier Thursday, another judge held a hearing on a lawsuit brought by Parker Tirrell and another student challenging the state law that bans transgender athletes in grades 5 to 12 from teams that align with their gender identity. It requires schools to designate all teams as either girls, boys or coed, with eligibility determined based on students’ birth certificates “or other evidence.” U.S. District Court Chief Judge Landya McCafferty ruled earlier this year that the teens can try out for and play on girls school sports teams. The order only applies to those two individuals for now as they seek to overturn the Fairness in Women’s Sports Act on behalf of all transgender girl students in New Hampshire. Lawyers for the teens said in court Thursday they hoped the matter could go to trial and be resolved before the start of the next school year in September. They said the teens’ school districts and others in the state have asked for guidance regarding the statute. Lawyers for the state said they needed more time to prepare. Judge Talesha Saint-Marc suggested the timing of the trial was ambitious and asked that both sides talk further about scheduling. Gov. Chris Sununu, who signed the Fairness in Women’s Sports Act into law in July, has said it “ensures fairness and safety in women’s sports by maintaining integrity and competitive balance in athletic competitions.” About half of states have adopted similar measures. In the Bow case, school district officials have said they acted appropriately in sanctioning the parents for conduct they knew violated school policy at athletic events. On Thursday, the plaintiff's lawyer, Endel Kolde, accused the district of “breathtaking” overreach by asserting that the wristbands target transgender students in general, regardless of whether such students were present at the events. “This is viewpoint discrimination, and it’s very clear they’re proud of it,” Kolde said. Kolde initially conceded that a school district can limit speech “to some degree” to protect children from harassment, but he stopped short of agreeing with the judge’s claim that yelling “transgender students out” at a particular player would be subject to such regulation. “It might be,” he said. “I’m trying to get you to concede the obvious,” McAuliffe said. “It’s less than obvious to me,” Kolde said. According to an announcement on Sunday by the speaker of the nation’s parliament, Mohammad Bagher Ghalibaf, Tehran has inaugurated new advanced centrifuges for nuclear enrichment. The UN atomic watchdog passed the resolution at its board of governors meeting on Thursday. The motion denounced Iran’s lack of transparency on its nuclear activities. While China, Russia, and Burkina Faso voted against, it was passed with 19 votes in favor. There were 12 abstentions and Venezuela did not vote, according to AFP sources. Mangione was taken into custody about 9:15 a.m. after police got a tip that he was eating at a McDonald’s in Altoona, Pennsylvania, police said. "He is believed to be our person of interest in the brazen, targeted murder of Brian Thompson,” NYPD Commissioner Jessica Tisch said. Mangione had clothing and a mask similar to those worn by the shooter and a fraudulent New Jersey ID matching one the suspect used to check into a New York City hostel before the shooting, Tisch said. NYPD Chief of Detectives Joseph Kenny said Mangione was born and raised in Maryland, has ties to San Francisco and a last known address in Honolulu, Hawaii. A message left Monday with a Philadelphia-area phone number connected to Mangione was not immediately returned. He was being held in Pennsylvania on gun charges and eventually will be extradited to New York to face charges in connection with Thompson’s death, Kenny said. Video posted on the social platform X showed him being led into the Blair County Courthouse for his first appearance. Police found a three-page document with writings suggesting that Mangione had “ill will toward corporate America,” Kenny said. The handwritten document “speaks to both his motivation and mindset,” Tisch said. Mangione had a ghost gun, a type of weapon that can be assembled at home from parts without a serial number, making them difficult to trace, investigators said. “As of right now the information we’re getting from Altoona is that the gun appears to be a ghost gun that may have been made on a 3D printer, capable of firing a 9 mm round,” Kenny said. Officers questioned Mangione, who was acting suspiciously and carrying multiple fraudulent IDs, as well as a U.S. passport, Tisch said. Officers found a suppressor, “both consistent with the weapon used in the murder,” the commissioner said. NYPD detectives and staff from the Manhattan district attorney’s office traveled to Altoona to interview Mangione, Kenny said. Thompson, 50, was killed last Wednesday as he walked alone to a hotel, where UnitedHealthcare’s parent company, UnitedHealth Group, was holding its annual investor conference, police said. UnitedHealth Group thanked law enforcement in a statement Monday. “Our hope is that today’s apprehension brings some relief to Brian’s family, friends, colleagues and the many others affected by this unspeakable tragedy,” a company spokesperson said. The shooting shook U.S. businesses and the health insurance industry in particular, causing companies to rethink security plans and delete photos of executives from their websites. The shooter appeared to be “lying in wait for several minutes” before approaching the executive from behind and opening fire, police said. He used a 9 mm pistol that police said resembled guns farmers use to put down animals without causing a loud noise. Mangione attended an elite Baltimore prep school, graduating as valedictorian in 2016, according to the school’s website. He went on to earn undergraduate and graduate degrees in computer science in 2020 from the University of Pennsylvania, a school spokesman said. Retracing the gunman’s steps using surveillance video, investigators say the shooter rode into Central Park on a bicycle and emerged from the park without his backpack. When Li Mo enlists an acquaintance to track her down and eventually travels there to meet her, he encounters a world in which gangsters and gamblers brush up against doctoral students. What inspired you to explore this milieu of Chinese migrants in Paris? Over the past ten years, I’ve been meeting more and more people who studied abroad—perhaps because of having moved from my home town, Shenyang, to Beijing. Back in Shenyang, many of my friends still live close to my old home. Recently, I went back to Shenyang to see my mother. While I was there, I met up with a middle-school classmate for a game of soccer. He still kicks the ball exactly the way he did twenty-eight years ago. Many people in Beijing aren’t Beijingers, and even when they are they may not have always lived there. One of my Beijing friends was in Paris for eight years but claims that he’s never had a Beijing accent, not even before he left—he hates the way Beijingers talk. I decided to write a story about his time in Paris and had a number of conversations with him. He makes Paris sound quite close to Beijing, as if you could drive there over a weekend. I should make it clear that my friend isn’t a gambler. It’s just that I’ve been wanting to write about gambling for a while. I have the feeling that, in an era when all meaning is being swallowed up, gambling might someday become humankind’s favorite activity. In the story, Li Mo discusses how Paris was “an ancient city of art, a place that championed égalité while hoarding power.” What does Paris represent for him, and for you? Have you been, and, if so, what was your impression of the city? I’ve been to Paris twice. On the first trip, one of my friends lost a camera at Charles de Gaulle Airport, and the whole group ended up sitting in a police station all night. There’d been disturbances in some Parisian neighborhoods, and rifle-toting police officers kept striding by confidently. They never found the camera, of course. You don’t need a gun to look for a camera. The second time was when Yueran (my wife, also a writer) was in Paris for a residency, and I came to spend a week with her. She was my tour guide and teacher. All I had to do was follow her around and make sure not to get lost. Paris, for me, means chairs that look out onto the street so people can sit facing the sidewalk. In China, we prefer to hide our faces while we eat, whereas the French like facing outward as they drink. There’s an expression in China that literally means “face staring at face”; that is, an awkward situation in which everyone is just looking at one another, uncertain what to say or do next. As I walked around Paris, that saying kept coming to mind. Your previous story for the magazine, “ Heart ,” focussed on the relationship between a father and a son, whereas in this one mother-son relationships take center stage: there’s Li Mo and his mother, who disappears from the family when he’s a child, and also Xiaoguo (the friend tasked with finding Li Lu) and his mother, an ailing Peking-opera singer. What do you think is unique about mother-son relationships, and what made you want to explore this connection here? I often analyze my mother’s words and actions, and sometimes I phone her to verify a childhood memory, which she always recalls with astounding clarity—yet I’ve rarely written about mothers and sons, and I can’t really say why. I’ve tried a few times but quickly got stuck or turned to a different subject after a couple of paragraphs. At the end of last year, when I needed surgery after injuring my knee playing soccer, my mother came to Beijing to take care of me. This was the most time we’d spent together in eight or nine years. I realized that we were more similar than I’d previously thought. There were many times when I’d drop a hint that only she understood. At the same time, this caused barriers between us: communicating mainly in hints can create a lot of misunderstandings. It’s better to be direct, but my mother and I are used to not speaking plainly to each other, and it feels as if doing so would push us further apart. After she went back to Shenyang, I thought I might be able to write a story about a mother and son. The Peking-opera performer represents a type of mother I’m familiar with: these mothers are unconstrained, not because their emotions don’t run as deep but because this is their only option. They have trained themselves to behave in this way. Xiaoguo studies film and makes a movie inspired by Marguerite Duras, and he and Li Mo visit a bookstore named after Jean-Pierre Melville’s “Le Cercle Rouge.” At one point, Li Mo also discusses how, “as long as you’re alive, you’ll enter other people’s consciousnesses, turning into a film clip, or at least some stills.” What is the importance of cinema in this story? I enjoy watching films and have taken part in some productions. Movies are very much about the material world, but they also require a spiritual dimension. When shooting a film, there are times when it’s hard to say if something is real or fake. When someone falls down, or when someone falls in love with another person, is that acting, or are these things actually happening? That’s what I love about movies—they’re the closest that reality can come to dreams. Movies are currently in decline because they take things too seriously. The contemporary world doesn’t like anything too solemn or earnest. Even the most irreverent film demands that you watch it at the cinema, which is itself an overserious thing to do. When shooting a film, as soon as a scene is captured, it immediately turns into a memory, a record—just as recalling an event can feel like screening a movie in our minds. I believe that people who don’t enjoy watching films may also dislike recollection. When the majority of people no longer enjoy movies, that will mean they’ve turned against memory on a grand scale. This story takes place during the early Internet age, when one could still chat with someone on a messaging platform without ever meeting them, or even seeing a photograph of them. What does this era represent for you? The early Internet age was a far more pleasant era—a time when you couldn’t send videos or make instant voice calls. Almost as if this technology had been ushered in by people who enjoyed writing letters, albeit letters that would receive immediate responses. The entire online world was connected through words. Thinking back, for this brief moment, the written word was at the height of its influence. At the end of the story, Li Mo makes a shocking discovery about Li Lu. Without ruining it for the reader, did you know that this was how the story was going to end as you were writing it? Do you think Li Mo ends up staying in Paris? I discovered the ending bit by bit in the course of writing this story. When I got there, I thought, Ah, so that’s how it is. This is often my writing process, a conversation with myself in which secrets are gradually revealed. Li Mo won’t stay in Paris, he’ll definitely return to Beijing. Fred Harris, a former U.S. senator from Oklahoma, presidential hopeful and populist who championed Democratic Party reforms in the turbulent 1960s, died Saturday. He was 94. Harris’ wife, Margaret Elliston, confirmed his death to The Associated Press. It was not immediately clear where he died, but he had lived in New Mexico since 1976 and was a resident of Corrales at the time of his death. “Fred Harris passed peacefully early this morning of natural causes. He was 94. He was a wonderful and beloved man. His memory is a blessing,” Elliston said in a text message. Harris served eight years in the Senate, first winning in 1964 to fill a vacancy, and made unsuccessful bid for the presidency in 1976. It fell to Harris, as chairman of the Democratic National Committee in 1969 and 1970, to help heal the party’s wounds from the tumultuous national convention in 1968 when protesters and police clashed in Chicago. He ushered in rule changes that led to more women and minorities as convention delegates and in leadership positions. “I think it’s worked wonderfully,” Harris recalled in 2004, when he was a delegate to the Democratic National Convention in Boston. “It’s made the selection much more legitimate and democratic.” “The Democratic Party was not democratic, and many of the delegations were pretty much boss-controlled or -dominated. And in the South, there was terrible discrimination against African Americans,” he said. Harris ran unsuccessfully for the Democratic presidential nomination in 1976, quitting after poor showings in early contests, including a fourth-place win in New Hampshire. The more moderate Jimmy Carter went on to win the presidency. Harris moved to New Mexico that year and became a political science professor at the University of New Mexico. He wrote and edited more than a dozen books, mostly on politics and Congress. In 1999 he broadened his writings with a mystery set in Depression-era Oklahoma. Throughout his political career, Harris was a leading liberal voice for civil rights and anti-poverty programs to help minorities and the disadvantaged. “Democrats everywhere will remember Fred for his unparalleled integrity and as a pioneer for instituting core progressive values of equity and opportunity for prosperity as core tenets of our party,” the Democratic Party of New Mexico said in a statement. Along with his first wife, LaDonna, a Comanche, he also was active in Native American issues. “I’ve always called myself a populist or progressive,” Harris said in a 1998 interview. “I’m against concentrated power. I don’t like the power of money in politics. I think we ought to have programs for the middle class and working class.” New Mexico Gov. Michelle Lujan Grisham praised his work for their shared state and the nation. “In addition to being a highly accomplished politician and professor, he was a decent, honorable man who treated everyone with warmth, generosity, and good humor,” she said in a statement. “Sen. Harris was a lesson in leadership that public officials would be wise to emulate now and forever.” Harris was a member of the National Advisory Commission on Civil Disorders, the so-called Kerner Commission, appointed by then-President Lyndon Johnson to investigate the urban riots of the late 1960s. The commission’s groundbreaking report in 1968 declared, “our nation is moving toward two societies, one black, one white — separate and unequal.” Thirty years later, Harris co-wrote a report that concluded the commission’s “prophecy has come to pass.” “The rich are getting richer, the poor are getting poorer and minorities are suffering disproportionately,” said the report by Harris and Lynn A. Curtis, president of the Milton S. Eisenhower Foundation, which continued the work of the commission. Norman Ornstein of the American Enterprise Institute said Harris rose to prominence in Congress as a “fiery populist.” “That resonates with people ... the notion of the average person against the elite,” Ornstein said. “Fred Harris had a real ability to articulate those concerns, particularly of the downtrodden.” In 1968, Harris served as co-chairman of the presidential campaign of then-Vice President Hubert Humphrey. He and others pressed Humphrey to use the convention to break with Johnson on the Vietnam War. But Humphrey waited to do so until late in the campaign, and narrowly lost to Republican Richard Nixon. “That was the worst year of my life, ’68. We had Dr. Martin Luther King killed. We had my Senate seatmate Robert Kennedy killed and then we had this terrible convention,” Harris said in 1996. “I left the convention — because of the terrible disorders and the way they had been handled and the failure to adopt a new peace platform — really downhearted.” After assuming the Democratic Party leadership post, Harris appointed commissions that recommended reforms in the procedures for selecting delegates and presidential nominees. While lauding the greater openness and diversity, he said there had been a side effect: “It’s much to the good. But the one result of it is that conventions today are ratifying conventions. So it’s hard to make them interesting.” “My own thought is they ought to be shortened to a couple of days. But they are still worth having, I think, as a way to adopt a platform, as a kind of pep rally, as a way to get people together in a kind of coalition-building,” he said. Harris was born Nov. 13, 1930, in a two-room farmhouse near Walters, in southwestern Oklahoma, about 15 miles from the Texas line. The home had no electricity, indoor toilet or running water. At age 5 he was working on the farm and received 10 cents a day to drive a horse in circles to supply power for a hay bailer. He worked part-time as a janitor and printer’s assistant to help for his education at University of Oklahoma. He earned a bachelor’s degree in 1952, majoring in political science and history. He received a law degree from the University of Oklahoma in 1954, and then moved to Lawton to practice. In 1956, he won election to the Oklahoma state Senate and served for eight years. In 1964, he launched his career in national politics in the race to replace Sen. Robert S. Kerr, who died in January 1963. Harris won the Democratic nomination in a runoff election against J. Howard Edmondson, who left the governorship to fill Kerr’s vacancy until the next election. In the general election, Harris defeated an Oklahoma sports legend — Charles “Bud” Wilkinson, who had coached OU football for 17 years. The search and rescue organization for Metro Vancouver’s North Shore mountains is warning people to do their research after two international visitors became stranded while relying on hiking apps to plan their routes. Allan McMordie with North Shore Rescue managed the Sunday night rescue of a man from Goat Ridge, a backcountry area behind Grouse Mountain. He said the man told rescuers he had not been expecting snow, despite two of the local ski hills opening with fresh powder last month. “All you had to do was look at the top of the mountains from Vancouver and know there’s snow up there,” he said in an interview. “To be in running shoes and not even expecting any snow was pretty naive.” The man from France had set out on a marked route, then decided to make his way through very rough, steep terrain to a separate trail at significantly higher elevation. “This is rugged backcountry,” McMordie said. “It’s almost impassable.” McMordie could not confirm which apps the hikers in both recent rescues were using, but said a lack of any marked route or trail reports is a good indication not to use the application. In any case, he said trip planning should involve multiple sources for information. If the man from France had done any research, McMordie said he would have discovered the backcountry area where he was rescued is closed for the winter. In both recent cases, he said there are signs at each trailhead with maps showing trails and topography, along with reminders about key steps in trip planning, he said. Both men were lucky to have been able to make 911 calls, McMordie added, as service is patchy in the area and their phone batteries had nearly run out. Above all, he said hikers should tell someone else where they’re going and when they expect to return, so that person can alert local authorities if necessary. “Absolutely nobody knew where this person was and what he was doing that day,” McMordie said of the man from France. “If he had not been able to get that (911) call out, he would still be there.” Sunday’s rescue on Goat Ridge came three days after a similar call, when another man”seriously underestimated the difficulty” of a route marked in an online hiking app, North Shore Rescue said in a statement posted to social media. The group said there is “barely a trail” in the summer and “nothing whatsoever” in the winter, making for “full mountaineering conditions” at this time of year. The man called for help after hiking for eight hours that left him “tired, soaked (and) hypothermic” as the sun was setting,” it said. It’s doubtful the man would have survived the night in the Mount Seymour backcountry if he hadn’t been able to make the call, the rescue group added. The man had been staying in a short-term accommodation and had taken an Uber to the trailhead. Only his girlfriend in Norway knew where he was, and he was not wearing or carrying adequate gear for the conditions, McMordie said. Vancouver-based Stephen Hui, the author of several B.C. hiking guidebooks, said the rough, mountainous terrain steps away from urban Metro Vancouver and the extent of the snowpack in winter is a surprise for many visiting hikers. Hui said online apps can be helpful and often provide commentary about trail conditions from other hikers, but it’s crucial to look at additional sources of information, including complete maps and provincial and national park websites. He said local authorities and outdoor groups have some responsibility for people heading into the backcountry, and there is room for more signage and education. Both Republicans and Democrats credentialed content creators to cover their conventions – and encouraged influencers to share their political messages. Influencers also interviewed the candidates and held fundraisers for them. But up until now, it has been difficult to get a sense of the size and characteristics of this new wave of news providers. A unique Pew Research Center study provides a deeper understanding of both the makeup of the news influencer universe and its audience. The project includes an in-depth examination of a sample of 500 popular news influencers and the content they produce, derived from a review of more than 28,000 social media accounts. We also conducted a nationally representative survey of Americans to better understand who regularly gets news from news influencers. While many news influencers are on multiple sites, there is also a different mix of influencers on each site. A closer look at five major social media sites, Facebook, Instagram, TikTok, X and YouTube, finds that news influencers on TikTok – a fast-growing destination for news in the U.S. – stand out from those on other sites in the following ways: News influencers largely offer independent voices from outside the news media. About three-quarters of news influencers (77%) have no past or present affiliation with a news media organization, while 23% have been employed in the news industry in some way. Those in the latter category include influencers who are currently affiliated with any news outlet (digital, TV, print, etc.), those who formerly worked in the news industry before becoming an independent influencer, and freelancers who have regularly contributed to news organizations. To get a sense of what news influencers are posting about, researchers collected all public posts by the 500 news influencers in our sample for three separate weeks in 2024: July 15-21, July 29-Aug. 4 and Aug. 19-25. We then analyzed these posts using a human-validated large language model. News influencers post about a wide range of topics. In fact, most of the posts by the news influencers in our sample during the three weeks (57%) could not be directly tied to current events or civic issues. Visitors can hear Björk's immersive, otherworldly soundscape, Nature Manifesto , over the next few weeks as they climb the long, glass escalator that hugs the side of Centre Pompidou in Paris, France. Björk is not only an Icelandic pop star, but also an avant-garde artist and climate activist. Her new sound installation blends the noises of endangered and extinct animals with her own voice, reading text she co-wrote alongside editor and photographer Aleph Molinari. "It is an emergency. The apocalypse has already happened. And how we will act now is essential," Björk recites over an array of ear-tingling wildlife noises that are sometimes natural, sometimes otherworldly. "In a pioneering sound strata of mutant peacocks, bees, and lemurs, biology will reassemble in new ways." A journey through different sonic worlds Created with IRCAM (Institut de Recherche et Coordination Acoustique/Musique), a preeminent music and sound research institute based in Paris, the installation employs field recordings of animal sounds. Some of these were manipulated using artificial intelligence. "As you go up the escalator, you go through all these different sonic worlds," said IRCAM sound artist Robin Meier Wiratunga , who collaborated with Björk on the installation. Capturing the sounds of lost species We don't know for sure what sounds many extinct animals made. University of Texas paleontologist Julia Clarke , who studies the sounds of extinct animals, said we can glean clues by studying sound-making in living species and the preserved soft tissues, skeletons and fossils of extinct ones. "We might look at the sound-producing structures, like vibratory vocal cords," Clarke said. "We might look at the structures that are rubbed together or banged together." Up to one million plant and animal species are facing extinction due to human activity including climate change, pollution and habitat loss, according to a 2019 global report on biodiversity. "What we've noticed in mass extinction is really the absence of sound," Clarke said. But she added that Nature Manifesto isn't only highlighting this catastrophic loss. It also suggests if we stop destroying the planet, that species might continue to evolve. "It's challenging us to think about in visceral ways what a very different and very acoustically diverse future might sound like," she said. "I hope it is that acoustically diverse." Jack Donaghy, the 2015 Daily Times Player of the Year, shared his insights on the importance of the storied rivalry. Donaghy, who threw for a then-program record 5,296 yards during his illustrious career – a record broken by Jake Ruane in 2018 – was instrumental in leading the Fords to the Central League title his senior year. In a winner-take-all showdown with Upper Darby in 2015, Donaghy delivered a legendary performance with 307 passing yards, five touchdowns through the air and two more rushing scores, including a dramatic 19-yard run to the end zone with 18 seconds left to secure the victory. “Jack’s in town so he was gracious enough to come in and talk about the 2015 season and all of the prep work that goes into a rivalry game,” Dougherty said after practice Monday night. “He just reminded these guys what a big one it is, and they were excited to hear from him. Why Alphabet Rallied This WeekOn Thursday 32 Bills passed in the Senate in an abrogation of the chamber’s role of scrutiny – and in an attack on democratic process. Rex Patrick provides a former insider’s perspective on what happened and who has democracy’s blood and follower betrayal on their hands. Parliament is nothing without procedure. It might be mainly of interest to political junkies, but it’s a critical part of our democracy. Parliament makes laws and the processes of the Parliament are intended to ensure the democratic, orderly and transparent consideration of those laws. Let’s start with proper process for the passage of a Bill through the Senate. Step 1: When a Bill is first introduced, along with an explanatory memorandum , it’s “ read a first time” . At this point the Bill can be referred to a Senate Committee for detailed examination; stakeholders and members of the public can have their say via submissions and senators can ask all sorts of questions of officials and subject matter experts. Step 2: The next stage is the second reading debate. During this stage, senators can choose to make a 15-minute speech to express their opinions about the Bill. The speech might persuade some senators to change their own views, especially independents. It’s also useful for putting a particular position on the record for later consideration by voters. The second reading is an important democratic step. At the conclusion of the debate, a vote is taken on the question “ that this bill be read a second time “. The Bill can be killed at this stage if the Government doesn’t have support for it. Step 3: The third reading, or ‘committee stage’, is a Q and A session around the Senate chamber. Senators ask questions of the minister on how the Government intends the Bill will work, and answers can even be used by Courts to later resolve any ambiguity in the law. The committee stage is also where amendments are moved and senators point out the purpose and benefits of them. Once the Bill leaves the ‘committee stage’, a vote is taken on the question, “ that this bill be read a third time ” If agreed to, the bill has passed all stages and assuming the House of Representative is willing to accept any Senate amendments, will go on to become law. A physical guillotine is an apparatus designed for cutting off a person’s head. A parliamentary guillotine is a procedure designed to cut off debate on a Bill. The guillotine can be used legitimately for an urgent Bill, or if senators are filibustering in debate. It’s not supposed to serve as a way to abrogate scrutiny and prevent advocacy for amendments. A guillotine can occur with majority approval of the Senate. That’s important, because Labor doesn’t have a majority in the Senate; Labor’s guillotine on 32 Bills on Thursday needed support from either the Liberals or the Greens. With Prime Minister Albanese desperate to get movement on legislation, a guillotine this week was as predictable as taxes. MMW did exactly this on Tuesday. On Wednesday evening, around 7:30 PM, the Government circulated a guillotine motion. At 8:30 PM independent senator Jacqui Lambie posted on BlueSky, alerting political die-hards that the Government had signalled ‘game on’, saying: Senators’ advisors, who were struggling through the end of a long sitting fortnight went on alert. A furious Lambie was to stand up in the Senate the following morning to rightfully hit out at the Leader of the Government in the Senate, Senator Wong. “Last night Minister Wong said all people in this place deserve a safe workplace, and, just an hour later, they sent a guillotine through like that. How is it safe for the employees in my office to go through 41 bills in a matter of about 12 hours? How is that safe? How bloody hypocritical. What about the right to disconnect?” Thursday morning would have seen deals being close to settled. At 9:03 AM, after morning prayers, Lambie stood in the Chamber and sought permission of senators to move a motion to scold the Government for their persistent guillotining of Bills – Labor had already dropped the guillotine blade on no less than 160 Bill thus far in this Parliament and was about to add to that tally. Permission was denied (any single senator can deny permission). Lambie then sought to ’suspend standing orders’ to ask the entire Senate if she could move her motion. Debate occurred. The interesting thing was – the Greens sat silently – and when it came to the vote that would allow Lambie to admonish Labor for their excessive guillotines, the Greens voted with the Government to stop her in her tracks. The Greens have long expressed strident opposition to the use of the guillotine. They understand it chops up democracy. This was expressed strongly through Greens Senator Mehreen Faruqi on 28 October, a month prior. “ The Senate is a place where a huge diversity of political views are heard and it is important that the Senate is facilitated by people who can also represent that plurality. But what we see again and again is a stitch-up between the two major parties, the Liberals and the Labor Party, and we see it again today. This is not the first time it has happened. We talk about democracy here—this is the chamber of review—but again and again democracy is shut down. How many times have we seen, just in the last couple of years, debate being shut down by guillotine motions? ...” So, back to last Thursday, one might have been surprised at what happened next. At 9:46 AM Labor’s Senator Gallagher rose to set up a guillotine. And the Greens supported it! The Government lost the vote 33 (yes) and 34 (no). The business of the Senate would, at least for a short while, take its ordinary course. If at First You Don’t Succeed At 12:20 PM Wong rose to her feet in the Senate to again seek to set up a guillotine. After 30 minutes of proposals and counterproposals across the chamber, a 30 Bill guillotine was put in place. The vote was won 34 (yes) to 32 (no). The Greens again supported the guillotine. But before putting the guillotine motion to the vote Wong foreshadowed adding two more Bills to the guillotine, one of which was the Online Safety Amendment (Social Media Minimum Age) Bill 2024 – a Bill that the Greens purportedly bitterly opposed. Wong then acted to include the further two Bills. The Greens knew that the Government, with Coalition support, had the numbers to pass the Social Media Minimum Age Bill, but supported it being included in the guillotine. That was despite the earlier words of Senator Sarah Hanson-Young on the Social Media Minimum Age Bill. Firstly, let me say what a disgrace it is that this bill, only tabled in the House of Representatives last Thursday, has been railroaded and rushed through the process here across the parliament. It was tabled in the House Thursday, sent to a Senate inquiry that sat for only three hours on Monday. Submissions from stakeholders and interested parties were open for less than 24 hours on Friday—talk about putting out the bins, taking out the rubbish! That’s exactly how this whole bill has been treated by the major parties. The reason that this bill is being rushed without scrutiny and without appropriate review is both the Leader of the Opposition, Mr Dutton, and the Prime Minister are worried that if people really knew about what the consequences of this piece of legislation meant, they wouldn’t support it. The Government’s deal with the Greens must have been a good one to flush away Hanson-Young’s concerns. And that includes the concern she had express about young and vulnerable children. They’ll be pushed into the darkest parts of the web and they won’t want to tell their parents what’s going on because they’ll be worried their phone will be taken away, so they will spiral further and further into isolation from their friends, their family, medical experts who may be able to help them, school counsellors and teachers. They’ll become even more isolated and vulnerable. Too bad, so sad kids! Hypocrisy and betrayal was thick in the air. Those watching the Chamber though would have seen the Greens opposing the Social Media Minimum Age Bill at the third reading stage – looking like they were fighting the good fight. But the reality was, they passed the Bill the moment they voted for the guillotine. What happened visually after that was just a swindle. (NYSE: JWN) today reported third quarter net earnings of $46 million , or earnings per diluted share ("EPS") of $0.27 , and earnings before interest and taxes ("EBIT") of $83 million . Excluding a charge related to accelerated technology depreciation, the Company reported adjusted EBIT of $97 million and adjusted EPS of $0.33 .[1] For the third quarter ended November 2, 2024, net sales increased 4.6 percent versus the same period in fiscal 2023, and total Company comparable sales increased 4.0 percent. Gross merchandise value ("GMV") increased 5.3 percent. Anniversary Sale timing, with one week shifting from the third quarter to the second quarter, had a negative impact of approximately 100 basis points on net sales compared with 2023. During the quarter, Nordstrom banner net sales increased 1.3 percent and comparable sales increased 4.0 percent. Net sales for Nordstrom Rack increased 10.6 percent and comparable sales increased 3.9 percent. THIRD QUARTER 2024 SUMMARY Total Company net sales increased 4.6 percent and comparable sales increased 4.0 percent compared with the same period in fiscal 2023. GMV increased 5.3 percent. The timing shift of the Anniversary Sale, with one day falling in the third quarter of 2024 versus eight days in 2023, had a negative impact on net sales of approximately 100 basis points compared with the third quarter of 2023. Nordstrom banner net sales increased 1.3 percent and comparable sales increased 4.0 percent compared with the same period in fiscal 2023. GMV increased 2.4 percent. The timing shift of the Anniversary Sale had a negative impact on Nordstrom banner net sales of approximately 200 basis points compared with the third quarter of 2023. Nordstrom Rack banner net sales increased 10.6 percent and comparable sales increased 3.9 percent compared with the same period in fiscal 2023. Digital sales increased 6.4 percent compared with the same period in fiscal 2023. The timing shift of the Anniversary Sale had a negative impact on Company digital sales of approximately 100 basis points compared with the third quarter of 2023. Digital sales represented 34 percent of total sales during the quarter. Gross profit, as a percentage of net sales, of 35.6 percent increased 60 basis points compared with 35.0 percent in the same period in fiscal 2023, primarily due to strong regular price sales. Ending inventory increased 5.9 percent compared with the same period in fiscal 2023, versus a 4.6 percent increase in sales. Selling, general and administrative ("SG&A") expenses, as a percentage of net sales, of 36.6 percent increased 25 basis points compared with 36.3 percent in the same period in fiscal 2023, primarily due to higher labor costs and a charge related to accelerated technology depreciation, partially offset by leverage on higher sales and improvements in variable costs across the business. Excluding the $14 million charge related to accelerated technology depreciation, adjusted SG&A expenses, as a percentage of net sales, were 36.2 percent. EBIT was $83 million in the third quarter of 2024, compared with $102 million during the same period in fiscal 2023. Adjusted EBIT of $97 million in the third quarter of 2024 excluded the accelerated technology depreciation. Adjusted EBIT of $77 million in the third quarter of 2023 excluded a favorable $25 million true-up related to the wind-down of Canadian operations.[2] Interest expense, net, of $26 million increased 8.8 percent compared with $24 million during the same period in fiscal 2023 primarily due to lower interest income. Income tax expense was $11 million , or 18.9 percent of pretax earnings, compared with income tax expense of $11 million , or 14.2 percent of pretax earnings, in the same period in fiscal 2023. The increase in the rate in the third quarter of fiscal 2024 was driven primarily by tax benefits in the third quarter of fiscal 2023 associated with the wind-down of Canadian operations.
