NEW YORK — Eager to preserve President-elect Donald Trump's hush money conviction even as he returns to office, prosecutors suggested various ways forward — including one based on how some courts handle criminal cases when defendants die. In court papers made public Tuesday, the Manhattan district attorney's office proposed an array of options for keeping the historic conviction on the books. The proposals include freezing the case until Trump is out of office, or agreeing that any future sentence wouldn't include jail time. Another idea: closing the case with a notation that acknowledges his conviction but says that he was never sentenced and his appeal wasn't resolved because of presidential immunity. The last is adopted from what some states do when a criminal defendant dies after being convicted but before appeals are exhausted. It is unclear whether that option is viable under New York law, but prosecutors suggested that Judge Juan M. Merchan could innovate in what's already a unique case. "This remedy would prevent defendant from being burdened during his presidency by an ongoing criminal proceeding," prosecutors wrote. But at the same time, it wouldn't "precipitously discard" the "meaningful fact that defendant was indicted and found guilty by a jury of his peers." Expanding on a position they laid out last month, prosecutors acknowledged that "presidential immunity requires accommodation during a president's time in office," but they were adamant that the conviction should stand. They argued that Trump's impending return to the White House should not upend a jury's finding. Trump wants the case to be thrown out in light of his election. His communications director, Steven Cheung, called prosecutors' filing "a pathetic attempt to salvage the remains of an unconstitutional and politically motivated hoax." Trump has fought for months to reverse his conviction on 34 counts of falsifying business records. Prosecutors said he fudged the documents to conceal a $130,000 payment to porn actor Stormy Daniels to suppress her claim that they had sex a decade earlier. He claims they didn’t and denies wrongdoing. Trump portrays the case as a political attack ginned up by District Attorney Alvin Bragg and other Democrats. Trump's legal team argues that letting the case continue would present unconstitutional "disruptions" to his upcoming presidential term. Trump's attorneys also cited President Joe Biden's recent pardon of his son Hunter Biden, who was convicted of tax and gun charges. Biden complained that his son was unfairly prosecuted for political reasons — and Trump's lawyers say he was, too. Trump's lawyers argued that the possibility of a jail sentence — even if it's after he leaves office — would affect his presidency. Prosecutors suggested Merchan could address that concern by agreeing not to put him behind bars. It's unclear how soon Merchan could decide what to do next with the case. He could grant Trump's request for dismissal, go with one of the suggestions from prosecutors, wait until a federal appeals court rules on Trump's parallel effort to get the case moved out of state court, or choose some other option. Trump, a Republican, takes office Jan. 20. He was scheduled for sentencing late last month. After Trump's Nov. 5 election win, Merchan halted proceedings and indefinitely postponed the former and future president's sentencing so the defense and prosecution could weigh in on the future of the case. Merchan also delayed a decision on Trump's prior bid to dismiss the case on immunity grounds. A dismissal would erase Trump's conviction, sparing him the cloud of a criminal record and possible prison sentence. Trump is the first former president to be convicted of a crime and the first convicted criminal to be elected to the office. The hush money case was the only one of Trump's four criminal indictments to go to trial. Since the election, special counsel Jack Smith ended his two federal cases, which pertained to Trump's efforts to overturn his 2020 election loss and allegations that he hoarded classified documents at his Mar-a-Lago estate. A separate state election interference case in Fulton County, Georgia, is largely on hold. Trump denies wrongdoing in each case.

The suspect in the shooting of UnitedHealthcare CEO Brian Thompson last week, 26-year-old Luigi Mangione, was thought by his mother to be living in San Francisco earlier this year, though it's not at all clear that he ever did. Social media has been flooded for the last 24 hours with postings that cast Luigi Mangione as both folk hero and murderer, and with plenty of images of him shirtless and smiling culled from his Instagram and Twitter accounts, which have since gone offline. As CNN reports , friends have known him for years to post images from his travels, and to maintain a mostly positive-seeming social media presence. That seems to have stopped earlier this year, and by July, friends were posting things publicly like "I haven’t heard from you in months," and "I don’t know if you are okay." One user also posted to Xitter in October, "Nobody has heard from you in months, and apparently your family is looking for you." Now we learn, as the Chronicle reports , that Mangione's mother filed a missing persons report with the San Francisco Police Department just a few weeks before the shooting, on November 18. In it she stated that she had last spoke to Mangione in July, and she believed he was working in the city at car-sales startup TrueCar, which is where he was listed on his LinkedIn as being employed. Kathleen Mangione reportedly told the SFPD she believed he was working at TrueCar at 124 Montgomery Street, which was listed as permanently closed, and it's not clear if TrueCar, which is based in Santa Monica, ever had offices there. Mangione's mother did not suggest that her son presented any kind of threat, and she reportedly told police she didn't know where he may have frequented in town. As SFist reported Monday shortly after Mangione's arrest, we know that he had an interest in AI and engineering, and that he had spent a summer in the Bay Area at Stanford in 2019, while he was attending undergrad at UPenn. He graduated in 2020, and CNN reports that he had been working remotely for TrueCar while living in Honolulu for about six months in 2022. The New York Times reports that, according to TrueCar, he had not been an employee since 2023. According to his family, Mangione had dropped out of contact sometime after having back surgery around August 2023, and that July contact with his mother is the last we know of. (His last post on his now-removed Instagram account had been photos from the Big Island in Hawaii in 2021.) A friend who runs a co-living compound in Honolulu for remote workers, RJ Martin, has spoken to both the Times and CNN and said that Mangione was mostly "upbeat," and they had been in touch until earlier this year, but Mangione went silent sometime around March or April. Martin said that Mangione had confided in him about his back issues — a spinal misalignment that caused him a good deal of pain — and said that he said he was not able to be physically intimate with another person without pain. Martin also said that Mangione's back problems were exacerbated after he took a surfing lesson in Hawaii in 2022, after which Mangione was "in bed for about a week." After last seeing family in Baltimore sometime last year, it seems like no one is sure where Mangione has been living for the past six to 12 months or more, and many friends have expressed disbelief that he could have undergone any sort of mental break. Indeed, a brief handwritten note found in his backpack when he was arrested Monday in Altoona, Pennsylvania suggests pretty solid lucidity, and he appeared to take full responsibility for the shooting death of Thompson. Per the Times, the note reads, "To save you a lengthy investigation, I state plainly that I wasn’t working with anyone... [healthcare companies] continue to abuse our country for immense profit because the American public has allowed them to get away with it," and he noted that during the time UnitedHealthcare’s market capitalization has grown, American life expectancy has not. LAS VEGAS — With a restructuring at Andretti Global that pushed Michael Andretti into a smaller role, the chances of his organization landing a Formula 1 team have substantially increased. So much so that F1 and Formula One Management could have a decision to grant the General Motors-backed entry a spot as the 11th team on the grid in the coming weeks. Dan Towriss, now the majority owner of the Andretti organization, was at the Las Vegas Grand Prix on Thursday scoping his chances of entering the top motorsports series in the world. So was the FBI, allegedly, as part of a Department of Justice investigation into why F1 denied the Andretti organization expansion into the series. F1 currently has 10 teams that field 20 cars and only one — the organization owned by California businessman Gene Haas — is an American team. Las Vegas marks the third race this season in the United States, more than any other country, as F1 has exploded in American popularity over the last five years. Even so, Andretti could not get approval from F1 to enter the series. But, the situation changed in September when Andretti scaled back his role with his namesake organization. Now with Towriss in charge, talks have amplified, even though it is not clear what the name of an Andretti-less F1 team would even be. Cadillac would do the engines — but says it won't be ready until 2028 — which means a 2026 Towriss-led F1 team would be GM branded but with a partner engine supplier. Most of the existing teams have been largely opposed to an 11th team entering F1, citing a dilution in prize money and the massive expenses they've already committed to the series. But, Andretti among others believed the teams' position was personal in that they simply didn't like Andretti, who ran 13 races in the 1993 season. His father, Mario, is the 1978 F1 world champion. The Andretti application had already been approved by the FIA, which is F1's ruling body, but later denied by F1 itself. F1 promised to revisit the issue once General Motors had an engine ready to compete. The existing 10 F1 teams have no actual vote or say in if the grid is expanded, which Mercedes boss Toto Wolff reiterated Thursday when The Associated Press asked why the sudden chance of acceptance in a potential 11th team. "We have an obligation, a statutory obligation as directors, to present the standpoint that is the best for our company and for our employees, and we've done that," Wolff said. "I think if a team can add to the championship, particularly if GM decides to come in as a team owner, that is a different story. "And as long as it is creative, that means we're growing the popularity of the sport, we're growing the revenue of the sport, then no team will be ever against it. So I'm putting my hope in there." Wolff has been eager to hear from Towriss directly on what the plans for the organization are now that Andretti has a smaller role. "No one from Andretti or Andretti Global or whatever the name will be has ever spoken to me a single sentence in presentation of what the creative part is," he said. "But they don't need to because the teams don't decide. It is the commercial rights holder, with the FIA, we have no say. If I want to be invited to a party and go to the party, I'm sitting down at the table and telling who I am and why I'm really good fun and sitting here and everybody will enjoy my presence. "That hasn't happened, but you know, that's now my personal point of view, not a professional, because there's nothing we can do, nothing we can say," Wolff continued. "And I don't know the people. I've obviously spoken to Mario. I didn't speak to his son. I didn't speak to any other people that are behind that. I don't know who they are. So I know GM, GM is great."
