Judge Tanya Chutkan agreed to the request by Special Counsel Jack Smith to dismiss the case against the president-elect "without prejudice," meaning it could potentially be revived after Trump leaves the White House four years from now. "Dismissal without prejudice is appropriate here," Chutkan said, adding in the ruling that "the immunity afforded to a sitting President is temporary, expiring when they leave office." Trump, 78, was accused of conspiring to overturn the results of the 2020 election he lost to Joe Biden and removing large quantities of top secret documents after leaving the White House, but the cases never came to trial. Smith also moved on Monday to drop his appeal of the dismissal of the documents case filed against the former president in Florida. That case was tossed out earlier this year by a Trump-appointed judge on the grounds that Smith was unlawfully appointed. The special counsel paused the election interference case and the documents case this month after Trump defeated Vice President Kamala Harris in the November 5 presidential election. Smith cited the long-standing Justice Department policy of not indicting or prosecuting a sitting president in his motions to have the cases dismissed. "The Government's position on the merits of the defendant's prosecution has not changed," Smith said in the filing with Chutkan. "But the circumstances have." "It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President," Smith said. "As a result this prosecution must be dismissed before the defendant is inaugurated." In a separate filing, Smith said he was withdrawing his appeal of the dismissal of the classified documents case against Trump but pursuing the case against his two co-defendants, Trump valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira. Trump, in a post on Truth Social, said the cases were "empty and lawless, and should never have been brought." LANDOVER, Md. (AP) — Allowing two kickoff return touchdowns and missing an extra point all in the final few minutes added up to the a third consecutive game in excruciating fashion. The underlying reason for this slide continuing was a problem long before that. An offense led by that was among the NFL's best for a long stretch of the season put up just nine points and 169 yards for the first three-plus quarters against Dallas before falling behind 20-9 and teeing off on the Cowboys' conservative defense. “We just couldn’t really get it going,” said , whose lengthy touchdown with 21 seconds left masked that he had just three catches for 16 yards through three quarters. “We’ve got to find a way to start faster and sustain drives, and that’s everybody: the whole coaching staff and the offensive players just going out there and figuring out ways that we can stay on the field.” This is not a new problem for Washington, which had a season-low 242 yards in a and 264 yards four days later at Philadelphia. Since returning from a rib injury that last month, Daniels has completed just under 61% of his passes, after 75.6% over his first seven professional starts. Seahawks safety Coby Bryant said earlier this week he had his “fingers crossed" that he might avoid punishment from the NFL for his celebration following a 69-yard interception return for a touchdown last Sunday that keyed Seattle’s 16-6 win over Arizona. It wasn’t to be as the NFL revealed Saturday that Bryant was indeed fined $6,594 for what was termed unsportsmanlike conduct for “obscene gestures” for his backward dive into the end zone accompanied by a little, uh, extracurricular activity that paid homage to former Seahawk Marshawn Lynch’s trademark move. There were no other fines levied from the game. In getting fined Bryant also found paid a small tribute to Lynch — Lynch was fined $11,050 following his dive-and-grab celebrating his “Beast Quake II’’ run against Arizona in 2014. Bryant also got better news from the league earlier in the week when he was named as the NFC’s Defensive Player of the Week. Bryant joked after the game that maybe Lynch would help him pay his fine. Ultimately, the Seahawks will likely consider it a small price to pay for what a play that may turn out to be as pivotal of the season. The play came on a fourth down with Arizona threatening to cut into Seattle’s 7-3 lead midway through the third quarter. The TD made it 13-3 and gave the Seahawks the breathing room they needed to win the game and move into a tie for first place with the Cardinals.
