NEW YORK (AP) -- President-elect Donald Trump's lawyers formally asked a judge Monday to throw out his hush money criminal conviction, arguing continuing the case would present unconstitutional "disruptions to the institution of the Presidency." In a filing made public Tuesday, Trump's lawyers told Manhattan Judge Juan M. Merchan that dismissal is warranted because of the extraordinary circumstances of his impending return to the White House. "Wrongly continuing proceedings in this failed lawfare case disrupts President Trump's transition efforts," the attorneys continued, before citing the "overwhelming national mandate granted to him by the American people on November 5, 2024." Trump's lawyers also cited President Joe Biden's recent pardon of his son, Hunter Biden, who had been convicted of tax and gun charges. They have said they will fight any efforts to dismiss the case but have indicated openness to delaying sentencing until after Trump's second term ends in 2029. In their filing Monday, Trump's attorneys dismissed the idea of holding off sentencing until Trump is out of office as a "ridiculous suggestion." Following Trump's election victory last month, Merchan halted proceedings and indefinitely postponed his sentencing, previously scheduled for late November, to allow the defense and prosecution to weigh in on the future of the case. He also delayed a decision on Trump's prior bid to dismiss the case on immunity grounds. Trump has been fighting for months to reverse the conviction, which involved efforts to conceal a $130,000 payment to porn actor Stormy Daniels, whose affair allegations threatened to disrupt his 2016 campaign. He has denied any wrongdoing. Trump takes office on Jan. 20. Merchan hasn't set a timetable for a decision. The defense filing was signed by Trump lawyers Todd Blanche and Emil Bove, who represented Trump during the trial and have since been selected by the president-elect to fill senior roles at the Justice Department. A dismissal would erase Trump's historic conviction, sparing him the cloud of a criminal record and possible prison sentence. Trump is the first former president to be convicted of a crime and the first convicted criminal to be elected to the office. Merchan could also decide to uphold the verdict and proceed to sentencing, delay the case until Trump leaves office, wait until a federal appeals court rules on Trump's parallel effort to get the case moved out of state court or choose some other option. Terrion Arnold Arnold has been great the last few games and this week was no exception. He held the Packers receivers to just 2 catches for 9 yards. After starting the season rough, Arnold has been great over the past few games, looking like he can be a true lockdown corner in the NFL. He has been a huge upgrade to the Lions secondary and if the Detroit Lions want to continue winning, he will need to continue his top-tier play. Linebackers The Detroit Lions entered the day with Jack Campbell being the only linebacker from the beginning of the season healthy, but you wouldn’t be able to tell with how they were playing. Campbell made big plays, but so did recent additions like Ezekiel Turner and David Long. Turner was all over the field making plays, including bringing Jordan Love down on a crucial third down at the end of the game that held Green Bay to a field goal. He was the highest-graded PFF player for the Detroit Lions this week and made a huge difference. Long also made a big play recovering a fumble off Christian Watson that resulted in 3 points for Detroit. The Lions have been battling injuries the whole year, but if the new additions can continue to make an impact, they will be able to go far in the playoffs. Losers Carlton Davis Davis has been great for Detroit this year, but this week he struggled. Davis gave up a chunk play to Christian Watson to open the second half followed by a TD just a few plays later. Although he gave up 4 catches for 120 yards, he did make a big play to force a fumble. Davis has been good this year so there’s not much to worry about. He needs to play better than if the Lions want to win. David Montgomery and Jahmyr Gibbs The Lions have gotten their running game going almost every game, but this week was an exception. The Packers did a great job holding both Gibbs and Montgomery to under 4 yards per carry, forcing Detroit to have to win the game in the air. Taylor Decker was out again, which likely played a big role in how the run game operated, but they still need to succeed. The Lions offense runs on the two running backs, so they will need to have a better game come playoff time if the Detroit Lions want to win. Final Thoughts With the Detroit Lions clinching a playoff spot in Thursday’s victory, they must ensure the Minnesota Vikings do not overtake them in the NFC North standings. WASHINGTON — The Commerce Department’s efforts to curb China’s and Russia’s access to American-made advanced computer chips have been “inadequate” and will need more funding to stymie their ability to manufacture advanced weapons, according to a new report from the Senate’s Permanent Subcommittee on Investigations. The Biden administration imposed export controls to limit the ability of China and Russia to access U.S.-made chips after Russia’s invasion of Ukraine nearly three years ago. The agency’s Bureau of Industry and Security, according to the report released this week, does not have the resources to enforce export controls and has been too reliant on U.S. chip makers voluntarily complying with the rules. But the push for bolstering Commerce’s export control enforcement comes as the incoming Trump administration says it is looking to dramatically reduce the size and scope of federal government. President-elect Donald Trump has tapped entrepreneurs Elon Musk and Vivek Ramaswamy to lead a new “Department of Government Efficiency” to dismantle parts of the federal government. The Trump transition team did not immediately respond to a request for comment on the report. BIS’s budget, about $191 million, has remained essentially flat since 2010 when adjusted for inflation. “While BIS’ budget has been stagnant for a decade, the bureau works diligently around the clock to meet its mission and safeguard U.S. national security,” Commerce Department spokesperson Charlie Andrews said in a statement in response to the report. Andrews added that with “necessary resources from Congress” the agency would be “better equipped to address the challenges that come with our evolving national security environment.” In a letter to Commerce Secretary Gina Raimondo on Wednesday, Democratic Sen. Richard Blumenthal of Connecticut, chair of the subcommittee, pointed to an audit of Texas Instruments that showed the Russian military continued to acquire components from Texas Instruments through front companies in Hong Kong to illustrate how the export controls are failing as an effective tool. The committee’s findings, Blumenthal said, suggest that Texas Instruments “missed clear warning signs” that three companies in its distribution chain had been diverting products to Russia. Texas Instruments did not immediately respond to a request for comment. “While Congress must provide BIS more resources to undertake its critical mission, it is long past time for BIS to make full use of the enforcement powers Congress has conferred upon it and take aggressive steps to cut the flow of U.S. semiconductors into the Russian war machine,” Blumenthal wrote. It’s not just Texas Instruments that’s the issue. The subcommittee in September published a report that found aggregated exports from four major U.S. advanced chip manufacturers nearly doubled from 2021 to 2022 to Armenia and Georgia. Both of those countries are home to front companies known to assist Russia in acquiring advanced chips made in the U.S. despite export controls. China, meanwhile, has created “vast, barely disguised smuggling networks which enable it to continue to harness U.S. technology,” the subcommittee report asserts. Washington has been gradually expanding the number of companies affected by such export controls in China, as President Joe Biden’s administration has encouraged an expansion of investments in and manufacturing of chips in the U.S. But Chinese companies have found ways to evade export controls in part because of a lack of China subject matter experts and Chinese speakers assigned to Commerce’s export control enforcement. The agency’s current budget limits the number of international end-use checks, or physical verification overseas of distributors or companies receiving American-made chips that are the supposed end users of products. Currently, Commerce has only 11 export control officers spread around the globe to conduct such checks. The committee made several recommendations in its report, including Congress allocating more money to hire additional personnel to enforce export controls, imposing larger fines on companies that violate controls and requiring periodic reviews of advanced chip companies’ export control plans by outside entities. Sandy Fonzo – the mother of Edward Kenzakoski, who died by suicide after spending time behind bars as part of the kickback scheme – said she was “shocked... and hurt” after learning of Biden’s decision to commute the rest of Conahan’s punishment. “Conahan‘s actions destroyed families, including mine, and my son‘s death is a tragic reminder of the consequences of his abuse of power,” Fonzo told the Citizens’ Voice, a local outlet. “This pardon feels like an injustice for all of us who still suffer. Right now I am processing and doing the best I can to cope with the pain that this has brought back.” Pennsylvania Gov. The Mazagon Docks Shipbuilders Ltd (MDL) created history by delivering two indigenously built, modern Capital Warships 'Nilgiri' and 'Surat' to the Indian Navy, officials said in Mumbai on Friday. The acceptance documents for the first Stealth Frigate of P17A Class, 'Nilgiri' and the fourth Guided Missile Destroy of P15B Class, 'Surat' were signed by MDL Chairman-Managing Director Sanjeev Singhal and CSO (Tech) R. Adhisrinivasan, and handed over to senior officials of Indian Navy. Both the warships have been designed by the IN's Warship Design Bureau, constructed by MDL and overseen by the Warship Overseeing Team, Mumbai. 'Nilgiri' is the First of Class (FoC) ship of Project 17A featuring cutting-edge advanced technology that is comparable to the finest ships of similar class anywhere in the world. It incorporates the design concepts for improved survivability, seakeeping, stealth and ship manoeuvrability with state of the art having stealth features through the shaping of the hull and use of radar transparent deck fittings, which make ships difficult to detect. It is packed with an array of sophisticated weapons and sensors and has all-around capability against enemy submarines, surface warships, anti-ship missiles, and fighter aircraft, mounted with guns for close-in-defence capability and effective naval gunfire. With significant indigenous content, 'Nilgiri' is enabled to operate independently without supporting vessels, and also to function as the flagship of the Naval task force. 'Surat' is the fourth ship of Project 15B and is a potent platform capable of undertaking a variety of tasks and missions, spanning the full spectrum of maritime warfare. It is armed with supersonic Surface-to-Surface 'Brahmos' missiles and 'Barak-8' Medium Range Surface to Air Missiles. Towards undersea warfare capability, the destroyer 'Surat' is fitted with indigenously developed anti-submarine weapons and sensors, prominently the Hull mounted Sonar Humsa NG, Heavyweight Torpedo Tube Launchers and ASW Rocket Launchers. Considerably more versatile than the previous classes of Destroyers and Frigates in Naval inventory, 'Surat' all-round capability against enemy submarines, surface warships, anti-ship missiles and fighter aircraft will enable it to operate independently without supporting vessels and also to function as the flagship of a Naval task force. The indigenous content in P15B Class Destroyers is 72 per cent which is a notch above their predecessors P15A 59 per cent and P15 42 per cent Class Destroyers, in tune with the 'Atmanirbhar Bharat' policy of the Centre.
