She has pleaded not guilty. The court heard the older sister allegedly engaged in a sexual act with her younger sister in February 2007 in the older sister's bedroom of their central Victorian home. At the time of the alleged offending, the older sister was aged around 16-17, while the younger sister was aged around 10-11. According to court documents, when interviewed by police the older sister denied the charges, but admitted to a sexual act between her and the sister around five years earlier than the alleged offending when the siblings shared a bedroom. The court heard the younger sister had no memory of this sexual act, which allegedly occurred when she was 5-6 years of age, and the older sister was around 10-11. The parents of the children were allegedly abusive, violent and smoked cannabis. Soon after the alleged incident in 2007, child protection services placed all of the children at the central Victorian home into foster care. The younger sister did not tell child protection services of the alleged offending, the court heard. She first reported it to police in 2021. During closing statements, prosecutor David Cordy called the older sister "an accomplished, manipulating liar" and said the defence was "grasping at straws". "[The older sister], at 17, would have known what she was doing was wrong," he said. "She certainly knows that now, that's why she has lied through her teeth." He claimed the older sister had changed her position due to a fear she would lose her children and go to jail. The prosecutor argued that evidence submitted over the course of the trial showed the younger sister was neither mistaken, nor a liar. "She gave a clear and consistent account of what happened to her just before her 11th birthday," Mr Cordy said. "This is not some lie dreamt up by [the younger sister] as an adult." Defence barrister Campbell Thomson called the younger sister's account "improbable, implausible, unsupported and unlikely". He argued she had mistakenly imagined the event, basing it on the sexual act during their childhood and conflating it with the trauma of being separated from her parents. "Human memory is not a computer hard drive," he said. "It can change over time." According to Mr Thomson, the older sister's bedroom was like a thoroughfare, where parents or other siblings "had to walk straight through". He claimed that if the incident had occurred, it would likely have been after school, when the siblings and at least one parent were at home, making the alleged incident "so improbable". "She's mistaken, she's confused, she's conflated two areas of her life when her mental health was poor," he said. The case was adjourned until today, December 9, when Judge Claire Quin will address the jury, and they will be retired to consider the case.
