BRIDGEPORT, W.Va. (WV News) – The Bridgeport boys basketball team isn’t yet at full strength, as four players who are expected to see regular playing time will be playing for a Class AAA state football championship this Saturday in Charleston. The Indians, however, thrived in their absence on Thursday. Bridgeport forced 18 turnovers – 10 in the first half – and held Liberty to single digits in three of the four quarters of its 69-26 victory over Liberty at Bridgeport. “It sure helped,” Bridgeport coach Dave Marshall said of the turnovers the Indians forced in their man-to-man defense. “We did not, and I mean this as a crazy compliment, we did not shoot the ball well. I just told them and I told them at halftime too, this is probably the best shooting outfit I’ve had since I’ve been here. I said, ‘That does not bother me, we took all good shots.’ “There’s nights where you have to let your defense grind and you have to get in transition. We’ve made an emphasis on trying to get better in transition. We’re still a work in progress, but we thought the turnovers that turned into offense on the other side, it was the right step. We have a long way to go, but it was a step in the right direction.” Beginning next Monday, Carter Zuliani, Jack Spatafore, Donovan Williams and Gavin Williams will be able to join the Bridgeport boys basketball team and will add to their depth in their games later in the week. Phoenix Sickles scored 19 points, Landon Sanders added 15, Anderson McDougal contributed 13 points and Aryon Dodd finished with 12 points. Bridgeport forced 11 turnovers in the first half and often converted off of them, including a pair of steals and transition layups by McDougal, the latter of which put the Indians ahead 13-3; another layup by McDougal stretched the Bridgeport lead to 15-6. “It’s a typical Dave Marshall Bridgeport team. They’re so good in their pack-line defense in the gaps, and it’s no surprise,” Liberty coach Zak Bart said. “We watched film of the last couple year’s games yesterday, and they’re really good at what they do. And the second thing is, we’re a dribble-drive team, and if we don’t do the little things away from the ball correctly to move people, then we’re in trouble and in for a long night.” Liberty’s Baustin Bowers, kept the Mountaineers relatively close early, hitting a layup, a jumper from the free-throw line and a turnaround jumper from the right baseline, which cut Liberty’s deficit to 19-12. But that was followed by a 12-0 Bridgeport run that featured a layup from Landon Sanders, a 3-pointer from Dodd, a put back and plus-one free throw from Sickles and a pair of free throws from Grayson Church: 31-12 Indians. “We knew coming in that we have a new group this year,” Bart said. “We only have two guys that have played varsity basketball before, and a couple kids that went to school here previously, so we knew there would be some nerves. I think a lot of those turnovers were nerves. We usually try to get under 10 as a good goal for us, and we’ll get there; give us a few games.” Leading 33-16 at the start of the third quarter, Bridgeport pulled away for good using a 19-0 run. Sickles scored eight of those points, including a 3-pointer from the right wing at the conclusion of the run that gave Bridgeport a 52-16 lead. That run finally came to an end on a 3-pointer from Eaden Spatafore, and following a put back from Sickles, Liberty’s Timmy Allman hit a layup which, in addition to Spatafore’s 3-pointer, were part of a five-point third quarter for the Mountaineers. Sanders still wasn’t done. After hitting another layup, he received a pass in the post and, after shaking a defender, buried another layup that gave the Indians a 58-21 lead. “Landon – and again, I mean this in all positive - Landon shot terrible,” Marshall said. “I think you know, he’s, in my opinion, one of the better shooters in the area. He didn’t shoot well, but he didn’t settle for that. He still scored 15 points with 1 of 7 from the three 3-poiint line. That’s a testament to how much he’s matured as a young man and a player, that he can still put up that kind of double digits without having his best shooting game.” Bridgeport still had its stroke from long range, as Dodd and Sanders each buried 3-pointers – Dodd from the left wing and Sanders near the top of the key – that were part of the six 3-pointers that Bridgeport drained on the night. Government regulators cleared American flights to get airborne Tuesday about an hour after the Federal Aviation Administration ordered a national ground stop, which prevented planes from taking off. American said in an email that the problem was caused by vendor technology in its flight operating system. Aviation analytics company Cirium said flights were delayed across American’s major hubs, with only 37% leaving on time. Nineteen flights were cancelled.
Special counsel Jack Smith moved to abandon two criminal cases against Donald Trump on Monday, acknowledging that Trump’s return to the White House will preclude attempts to federally prosecute him for retaining classified documents or trying to overturn his 2020 election defeat. The decision was inevitable, since longstanding Justice Department policy says sitting presidents cannot face criminal prosecution. Yet it was still a momentous finale to an unprecedented chapter in political and law enforcement history, as federal officials attempted to hold accountable a former president while he was simultaneously running for another term. Trump emerges indisputably victorious, having successfully delayed the investigations through legal maneuvers and then winning reelection despite indictments that described his actions as a threat to the country’s constitutional foundations. “I persevered, against all odds, and WON,” Trump exulted in a post on Truth Social, his social media website. He also said that “these cases, like all of the other cases I have been forced to go through, are empty and lawless, and should never have been brought.” The judge in the election case granted prosecutors’ dismissal request. A decision in the documents case was still pending on Monday evening. The outcome makes it clear that, when it comes to a president and criminal accusations, nothing supersedes the voters’ own verdict. In court filings, Smith’s team emphasized that the move to end their prosecutions was not a reflection of the merit of the cases but a recognition of the legal shield that surrounds any commander in chief. “That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind,” prosecutors said in one of their filings. They wrote that Trump’s return to the White House “sets at odds two fundamental and compelling national interests: on the one hand, the Constitution’s requirement that the President must not be unduly encumbered in fulfilling his weighty responsibilities ... and on the other hand, the Nation’s commitment to the rule of law.” In this situation, “the Constitution requires that this case be dismissed before the defendant is inaugurated,” they concluded. Smith’s team said it was leaving intact charges against two co-defendants in the classified documents case — Trump valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira — because “no principle of temporary immunity applies to them.” Steven Cheung, Trump’s incoming White House communications director, said Americans “want an immediate end to the political weaponization of our justice system and we look forward to uniting our country.” Trump has long described the investigations as politically motivated, and he has vowed to fire Smith as soon as he takes office in January. Now he will start his second term free from criminal scrutiny by the government that he will lead. The election case brought last year was once seen as one of the most serious legal threats facing Trump as he tried to reclaim the White House. He was indicted for plotting to overturn his defeat to Joe Biden in 2020, an effort that climaxed with his supporters’ violent attack on the U.S. Capitol on Jan. 6, 2021. But the case quickly stalled amid legal fighting over Trump’s sweeping claims of immunity from prosecution for acts he took while in the White House. The U.S. Supreme Court in July ruled for the first time that former presidents have broad immunity from prosecution, and sent the case back to U.S. District Judge Tanya Chutkan to determine which allegations in the indictment, if any, could proceed to trial. The case was just beginning to pick up steam again in the trial court in the weeks leading up to this year’s election. Smith’s team in October filed a lengthy brief laying out new evidence it planned to use against him at trial, accusing him of “resorting to crimes” in an increasingly desperate effort to overturn the will of voters after he lost to Biden. In dismissing the case, Chutkan acknowledged prosecutors’ request to do so “without prejudice,” raising the possibility that they could try to bring charges against Trump when his term is over. She wrote that is “consistent with the Government’s understanding that the immunity afforded to a sitting President is temporary, expiring when they leave office.” But such a move may be barred by the statute of limitations, and Trump may also try to pardon himself while in office. The separate case involving classified documents had been widely seen as legally clear cut, especially because the conduct in question occurred after Trump left the White House and lost the powers of the presidency. The indictment included dozens of felony counts accusing him of illegally hoarding classified records from his presidency at his Mar-a-Lago estate in Palm Beach, Florida, and obstructing federal efforts to get them back. He has pleaded not guilty and denied wrongdoing. The case quickly became snarled by delays, with U.S. District Judge Aileen Cannon slow to issue rulings — which favored Trump’s strategy of pushing off deadlines in all his criminal cases — while also entertaining defense motions and arguments that experts said other judges would have dispensed with without hearings. In May, she indefinitely canceled the trial date amid a series of unresolved legal issues before dismissing the case outright two months later. Smith’s team appealed the decision, but now has given up that effort. Trump faced two other state prosecutions while running for president. One of them, a New York case involving hush money payments, resulted in a conviction on felony charges of falsifying business records. It was the first time a former president had been found guilty of a crime. The sentencing in that case is on hold as Trump’s lawyers try to have the conviction dismissed before he takes office, arguing that letting the verdict stand will interfere with his presidential transition and duties. Manhattan District Attorney Alvin Bragg’s office is fighting the dismissal but has indicated that it would be open to delaying sentencing until Trump leaves office. Micron’s revenues for the past three months were $8.7 billion, an 85% increase from the same period last year, the company reported today. Micron turned a $2 billion profit for the quarter. Micron’s previous record quarterly revenues were $8.6 billion, for the three months ending in May 2022. Micron’s fiscal year runs from Sept. 1 to Aug. 31. Results announced today were from the quarter that ended Nov. 28. Today’s report marks a dramatic turnaround from a year ago, when the company posted a $1.2 billion loss on revenues of $4.7 billion. Micron last week signed a deal to get up to $6.1 billion in taxpayer subsidies from the U.S. Department of Commerce. The money would be used to build two memory chip manufacturing plants in the town of Clay and one in Boise, Idaho, the company’s headquarters. The money isn’t paid upfront, but would be doled out as Micron reaches certain construction and equipment installation milestones. The Commerce Department has said it will not release the formal agreement with Micron that details those milestones. Micron says it plans to break ground in November 2025 on the two fabrication plants, or fabs, in Clay. Building and outfitting those two fabs could cost about $50 billion, the company estimates. Micron could see $20 billion in taxpayer subsidies for the Clay project, about 40% of the total cost for the two fabs. Micron has said it plans to build two more fabs after that. Micron is expected to submit a preliminary environmental report to government agencies this week on the potential impacts of the Clay project. The review and public airing of that plan is likely to continue into next summer. By Molly Farrar A Boston man who allegedly assaulted a transgender woman at a Blue Line MBTA station on Halloween is facing charges of assault and violating the victim’s civil rights, officials said. Gregory Burnett, 53, pleaded not guilty to assault and battery causing serious bodily injury, assault and battery, assault and battery with a dangerous weapon (his foot), and a civil rights violation with injury, Suffolk County District Attorney Kevin Hayden said. The woman, 41, told police that another passenger boarded the train at Maverick, immediately approached her, and shouted “derogatory terms” at her, the DA said. Burnett allegedly said statements including “you’re not a woman, you’re a man.” Burnett then punched and kicked her, including in the crotch area. The woman tried to defend herself, the DA said, but Burnett grabbed her foot and caused her to fall and fracture her wrist. Other passengers helped the woman defend herself against Burnett and get him off the train, officials said. The woman reported the incident to police the next day and said “she felt targeted due to her gender identity based on Burnett’s remarks during the assault,” the DA said. MBTA police used witness descriptions and surveillance video to identify Burnett and apprehend him at Maverick last Tuesday, according to Hayden’s office. Burnett was initially held in jail after being found dangerous in court, but was released last week on conditions to stay at home outside of work hours, according to court records. With a GPS, he is confined to his home outside of 7 a.m. to 3 p.m., Monday through Friday. He is also required to maintain employment, stay away from any witnesses, not commit any further offenses, and not possess any firearms. The Associated Press called the initiative Wednesday evening. According to the California Secretary of State, the measure is ahead 50.8% to 49.2%. As written, Proposition 34 applies to healthcare providers who have spent more than $100 million in any 10-year period on things besides direct patient care and have run multifamily housing with more than 500 “high-severity health and safety violations.” If a healthcare provider meets that standard they would be required to spend 98% of their revenues from a federal prescription drug program on direct patient care. The measure was sponsored by the California Apartment Assn., whose campaign committee said the new rules could apply to multiple organizations and noted the initiative’s language did not name any specific group. In the weeks before the election, much of the advertising in favor similarly did not name a specific healthcare provider, but emphasized Proposition 34 would save taxpayers money while also increasing spending on patient care. However, the apartment association did single out the AIDS Healthcare Foundation by name as a target during the campaign and no other health organization has such a well-publicized history of operating housing with health and safety complaints and spending money on things other than direct patient care. The AIDS Healthcare Foundation has bankrolled three initiatives to dramatically expand rent control in recent years, including Proposition 33 on this year’s ballot. All of those measures were defeated , but forced the real estate industry to spend hundreds of millions of dollars in opposition. The AIDS Healthcare Foundation, or AHF, earns most its revenue off the federal drug program at question. The program, known as 340B, requires drug makers to sell their drugs at discounts to certain healthcare providers, who then turn around and charge health insurance companies more for the drugs. According to California’s nonpartisan Legislative Analyst’s Office, the program is supposed to enable providers like AHF to serve more low-income patients, but the law “does not directly restrict how providers spend their revenue from federal drug discounts.” Proposition 34’s restrictions could hamstring AHF’s ability to fund additional rent control measures or operate apartments it owns in and around Skid Row, which have been beset with vermin infestations, elevator failures and other problems, according to a Times investigation published last fall. In a statement, AHF president Michael Weinstein said that the organization would continue to fight for renters. “The results of Propositions 33 and 34 prove only one thing: If billionaires spend more than $170 million lying and confusing voters, they are virtually guaranteed to win,” Weinstein said. What happens next is unclear. Prior to the election, AHF unsuccessfully sued to take Proposition 34 off the ballot, arguing it was unconstitutional because it so singularly targets the organization. However, one legal expert previously told the Times courts generally are reluctant to remove measures before an election and that there was a “good chance” a judge would find the measure unconstitutional if it passed. In an email, AHF spokeswoman Jacki Schechner said that organization would decide on what legal action to take once it sees how the law will be applied. The Yes on 34 campaign declared victory last week, before the race was called by the Associated Press, saying voters took action to close a “loophole” that allowed healthcare organizations to spend money meant for patients on “luxury condos, CEO bonuses, naming rights on sports stadiums, and political campaigns.”
