UPPER Hunter mine maintenance companies Brauntell and Brauntell MBK have been placed in the hands of an administrator with debts totalling more than $20 million. Login or signup to continue reading Administrator Daniel Walley, of PwC Australia, was appointed to the associated companies in September. According to a statutory report by Mr Walley from October 9, Bruantell has 91 creditors owed $13.48 million. These are made up of 23 secured creditors owed $4.55 million and 58 unsecured trade creditors owed $1.08 million. It's understood Brauntell owes Brauntell MBK about $6.1 million. Brauntell was established in 1995, is based at Mount Thorley, and purchased Brauntell MBK, also known as MBK, in 2016, which is based at Muswellbrook. The companies were forced into administration after the Australian Taxation Office issued director penalty notices in August for unpaid taxes, superannuation and GST. The director of both companies is Anthony Farrell, 50, of Muswellbrook. MBK owes about $8.86 million. This includes $2.33 million owed to three secured creditors, $1.89 million owed to 70 employees and $4.63 million owed to statutory creditors including the tax office and iCare. According to Mr Walley, who has recommended the companies be liquidated, they failed because they did not manage their tax debts. He noted there was also a high level of investment in IT and a large number of related-party consultant fees paid. It's understood the companies operated as a group providing maintenance, repairs and overhauls of mining equipment and heavy machinery. "The director attributes the failure to undercapitalisation of a rapidly growing business, poor industry conditions and volatility with projects and supplier agreements," Mr Walley wrote. "Our preliminary view is that Brauntell may have been insolvent from at least 30 June 2023 and MBK from 30 June, 2022." According to the report, preliminary investigations of Brauntell's records reveal a possible insolvent trading claim against Mr Farrell of between $2.3 million to $8.3 million. This figure is dependent on any defences provided by the director, the shortfall from secured creditors and if related-creditor amounts are valid. Similarly, a possible insolvent trading claim against Mr Farrell for Brauntell MBK is estimated between $4.5 million and $6.7 million. According to Mr Walley, Brauntell incurred a large tax debt when several outstanding returns were lodged in January 2023 for periods dating back to December 2021. MBK also made late lodgements to the tax office at the start of last year for periods dating back to November 2021. Despite the companies making several payments, the tax debts continue to grow. Mr Walley said investigations revealed that about $2.582 million was paid to unknown or related-party consultants since September 2023. He said further investigation was required to determine if the transactions could be pursued on behalf of creditors. This includes $2.4 million paid to IT company Blue Collar Technology for the "development of bespoke software for Brauntell". According to Mr Walley, Blue Collar is owned by Mr Farrell and solely serviced Brauntell. "Whilst these consultants may have provided legitimate services to the business, questions are raised due to the large quantum of funds paid for consultants and the insufficient supporting documentation on the Xero management accounts," he wrote. "A liquidator would be able to conduct further investigations into these transactions and determine if any of them give rise to potential voidable transaction claims." The congressionally mandated agreement allows transition aides to work with federal agencies and access non-public information and gives a green light to government workers to talk to the transition team. But Trump has declined to sign a separate agreement with the General Services Administration that would have given his team access to secure government offices and email accounts, in part because it would require that the president-elect limit contributions to $5,000 and reveal who is donating to his transition effort. The White House agreement was supposed to have been signed by Oct. 1, according to the Presidential Transition Act, and the Biden White House had issued both public and private appeals for Trump’s team to sign on. The agreement is a critical step in ensuring an orderly transfer of power at noon on Inauguration Day, and lays the groundwork for the White House and government agencies to begin to share details on ongoing programs, operations and threats. It limits the risk that the Trump team could find itself taking control of the massive federal government without briefings and documents from the outgoing administration. As part of the agreement with the White House, Trump’s team will have to publicly disclose its ethics plan for the transition operation and make a commitment to uphold it, the White House said. Transition aides must sign statements that they have no financial positions that could pose a conflict of interest before they receive access to non-public federal information. Biden himself raised the agreement with Trump when they met in the Oval Office on Nov. 13, according to the White House, and Trump indicated that his team was working to get it signed. Trump chief of staff-designate Susie Wiles met with Biden’s chief of staff Jeff Zients at the White House on Nov. 19 and other senior officials in part to discuss remaining holdups, while lawyers for the two sides have spoken more than a half-dozen times in recent days to finalize the agreement. “Like President Biden said to the American people from the Rose Garden and directly to President-elect Trump, he is committed to an orderly transition,” said White House spokesperson Saloni Sharma. “President-elect Trump and his team will be in seat on January 20 at 12 pm – and they will immediately be responsible for a range of domestic and global challenges, foreseen and unforeseen. A smooth transition is critical to the safety and security of the American people who are counting on their leaders to be responsible and prepared.” Without the signed agreement, Biden administration officials were restricted in what they could share with the incoming team. Trump national security adviser-designate Rep. Mike Waltz met recently with Biden national security adviser Jake Sullivan, but the outgoing team was limited in what it could discuss. “We are doing everything that we can to effect a professional and an orderly transition,” White House national security spokesman John Kirby told reporters on Monday. “And we continue to urge the incoming team to take the steps that are necessary to be able to facilitate that on their end as well.” “This engagement allows our intended Cabinet nominees to begin critical preparations, including the deployment of landing teams to every department and agency, and complete the orderly transition of power,” said Wiles in a statement. The Trump transition team says it would disclose its donors to the public and would not take foreign donations. A separate agreement with the Department of Justice to coordinate background checks for vetting and security clearances is still being actively worked on and could be signed quickly now that the White House agreement is signed. The agency has teams of investigators standing by to process clearances for Trump aides and advisers once that document is signed. That would clear the way for transition aides and future administration appointees and nominees to begin accessing classified information before Trump takes office. Some Trump aides may hold active clearances from his first term in office or other government roles, but others will need new clearances to access classified data. Trump’s team on Friday formally told the GSA that they would not utilize the government office space blocks from the White House reserved for their use, or government email accounts, phones and computers during the transition. The White House said it does not agree with Trump’s decision to forgo support from the GSA, but is working on alternate ways to get Trump appointees the information they need without jeopardizing national security. Federal agencies are receiving guidance on Tuesday on how to share sensitive information with the Trump team without jeopardizing national security or non-public information. For instance, agencies may require in-person meetings and document reviews since the Trump team has declined to shift to using secure phones and computers. For unclassified information, agencies may ask Trump transition staff to attest that they are taking basic safeguards, like using two-factor authentication on their accounts.

EDITORS DESK Last week, the Bureau of Customs (BOC) posted a notice of public auction for two high profile hypercars that were seized early this year. The cars in questions are two Bugatti Chiron hypercars that managed to evade customs and were plying Philippine roads for some time. Quite puzzlingly, these two vehicles were able to be registered, acquire plate numbers, and even gated village stickers. For the uninitiated, the Bugatti Chiron is one of the world’s most expensive performance vehicles. The vehicle is one of only a handful capable of producing over 1000-hp in stock form and on to a top speed of over 420-km/h. These performance figures are quite high, even for cars in this caliber. Naturally, they’re also quite limited and very expensive. Also, this vehicle is already discontinued, further limiting its availability. Each car is valued at least as much as ₱165 million each, when brand new. Of course, if it were imported legally into the country, with our web of vehicle taxes, excise taxes, tariffs and shipping dues, the cars can easily double in price to as much as ₱330 million when brand new. Not surprisingly, the BOC set the floor price for these vehicles at a hair above ₱300 million. Take note however that these vehicles are already used. One is a 2017 model and another is a 2019 model. As such, the appropriate vehicle depreciation should have been taken into account. Nonetheless, it shouldn’t be too much, putting their price still above the ₱250 million range. A few days later, the BOC declared the auction a failure as no bids were submitted for the two vehicles. It shouldn’t have come as a surprise to the agency as these prices are already quite high as far as supercars go. Not the price but the seller However, it’s not the price itself that’s the problem. There are many millionaires who will willingly drop ₱100-M on the latest set of Porsche, Lamborghini, or Ferrari models. Rather, it is about who is selling them. Any buyer that does have the ₱300-M lying around to buy one likely won’t want to transact with the government for fear that their name, recent purchases, and source of income might come under scrutiny. If they truly want to sell the vehicles for that hefty sum, perhaps hiring a third party auctioneer, such as Salcedo Auctions, would be more successful. Just don’t ask who the buyer is, give the auctioneer their cut, and simply put the funds to better use. After all, this new price already includes the taxes. Everything should then be in order so long as the price is paid. Use them as an example Of course, there’s also the possibility that such cars that have graced multiple broadsheet and news program headlines are already deemed tainted goods by any prospective buyer. Who would want to be seen driving a vehicle once labeled as smuggled? Rather than simply crush the cars for what little media mileage and good governance press that is worth, why not take the cars on a nationwide tour. There’s no better proof of the sheer greed and brazenness of smugglers than these vehicles. As such, why not take these cars on a nationwide tour around the country’s cities. Put them on display in public spaces, along with panels that break down just how many schools, ambulances, or relief goods that properly paid taxes from these cars could have bought. Illustrate why high tariffs are placed on cars like these in the first place — to generate revenue for the country from the wealthy that want to spend on flashy personal vehicles rather than charitable institutions that help their countrymen. Emphasize that these taxes and tariffs are slapped on to also protect the local and regional vehicle assemblers that give jobs to Filipinos and Asians. High taxes paid for cars like these are what allow the government to lower taxes on more affordable and locally built vehicles like the Toyota Vios, Innova, and soon, the Tamaraw. With such a nationwide tour, we can educate our countrymen on the value of properly documenting imported goods, taxes, and tariffs. It’s not about giving the government more money, but protecting our own industries and those businesses that do pay the proper taxes. Perhaps then our countrymen will be better informed on why these duties are imposed in the first place. (Iñigo S. The Southeast Development Youth Stakeholders Forum (SEDYSF), a coalition of youth groups from Nigeria’s southeastern region, has called on President Bola Tinubu to appoint Senator Rochas Okorocha as Chairman of the Southeast Development Commission (SEDC). The youth group, in a passionate appeal, described Okorocha as the best candidate to lead the commission tasked with spearheading the region’s development agenda. LONDON — A woman who claimed mixed martial arts fighter Conor McGregor “brutally raped and battered” her in a Dublin hotel penthouse was awarded nearly 250,000 Euros ($257,000) on Friday by a civil court jury in Ireland. The woman said the Dec. 9, 2018, assault after a night of partying left her heavily bruised and suffering from post-traumatic stress disorder. McGregor shook his head as the jury of eight women and four men returned the verdict after deliberating for about six hours in the High Court in Dublin. He was mobbed by cameras as he left court but did not comment. The former UFC champion later posted on his X social media account that he planned to appeal the decision . McGregor testified that he never forced the woman to do anything against her will and said she fabricated the allegations after the two had consensual sex. The woman’s voice and hands trembled as she read a statement outside the courthouse, saying she would never forget what happened to her but would now be able to move on with her life. She thanked her family, partner, friends and all the supporters that had reached out to her online, but particularly her daughter. “She has given me so much strength and courage over the last six years throughout this nightmare to keep on pushing forward for justice,” the woman said. “I want to show (her) and every other girl and boy that you can stand up for yourself if something happens to you, no matter who the person is, and justice will be served.” Her lawyer told jurors that McGregor was angry about a fight he had lost in Las Vegas two months earlier and took it out on his client. “He’s not a man, he’s a coward,” attorney John Gordon said in his closing speech. “A devious coward and you should treat him for what he is.” The woman had to take several breaks in her emotional testimony as she said McGregor threatened to kill her during the encounter. A paramedic who examined the woman the next day, testified that she hadn’t seen someone with that intensity of bruising. The woman said McGregor put her in a chokehold several times and later told her, “Now you know how I felt in the Octagon where I tapped out three times,” referring to an Oct. 6 fight at UFC 229 in Las Vegas when he lost via submission to lightweight champion Khabib Nurmagomedov , followed by a wild post-fight brawl . She feared she would die and never see her daughter again. “He let me go and I remember saying I was sorry, as I felt that I did something wrong and I wanted to reassure him that I wouldn’t tell anyone so he wouldn’t hurt me again,” she said. She said she then let him do what he wanted and he had sex with her. Police investigated the woman’s complaint, but prosecutors declined to bring charges, saying there was insufficient evidence and a conviction was unlikely. McGregor said the two had sex that was athletic and vigorous, but not rough. He said “she never said ‘no’ or stopped” and testified that everything she said was a lie. “It is a full-blown lie among many lies,” he said when asked about the chokehold allegation. “How anyone could believe that me, as a prideful person, would highlight my shortcomings.” McGregor’s lawyer told jurors they had to set aside their animus toward the fighter. On the advice of his lawyer, he refused to answer more than 100 follow-up questions.
